Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his combat service in Grenada and all awards which he is authorized based on this service. 2. The applicant states, in effect: * he was in combat in Grenada (Operation Urgent Fury) from 27 October to 30 November 1983 * this combat deployment is not currently reflected on his DD Form 214 for the period ending 31 May 2009 * his DD Form 214 also does not list any awards resulting from this deployment * he requests this correction so that his family has a true and correct history of his 26 years of military service * he is also requesting the correction for Department of the Veterans Affairs (VA) purposes 3. The applicant provides: * DD Form 214 for the period ending 31 May 2009 * letter from the Defense Finance and Accounting Service, dated 19 March 2010 * Letter from the National Personnel Records Center, dated 29 June 2015 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 11 March 1983. He served continuously through reenlistments and extensions, and rose to the rank/grade of first sergeant/E-8. 3. His official military personnel file contains a DA Form 2-1 (Personnel Qualification Record - Part II). Item 5 (Overseas Service) shows the applicant deployed to Grenada from on or about 25 October to 4 November 1983. Item 9 (Awards, Decorations, and Campaigns) lists campaign credit for Urgent Fury. 4. He honorably retired on 31 May 2009. His DD Form 214 shows he completed 26 years, 2 months, and 20 days of net active creditable service. a. Item 18 (Remarks) shows the following periods served in imminent danger areas: * Bosnia - 15 October 1999 to 3 May 2000 * Afghanistan - 23 June to 21 December 2002 * Iraq - 26 August to 6 December 2003 REFERENCES: 1. AR 600-8-22 (Military Awards) prescribes policies and procedures for military awards. a. The Armed Forces Expeditionary Medal is authorized for qualifying service after 1 July 1958 in military operations within specific geographic areas during specified time periods. (1) Table 2-3 (Armed Forces Expeditionary Medal) indicates Grenada - Operation Urgent Fury (23 October to 21 November 1983) was an authorized military operation. (2) Table 2-4 (Armed Forces Expeditionary Medal - Designated U.S. Military Operations in Direct Support of the United Nations) shows Operation Joint Forge (OJF) (21 June 1998 to 23 March 1999) was an authorized military operation. Only one award of either the Armed Forces Expeditionary Medal or the Armed Forces Service Medal is authorized for participation in OJF. b. The Armed Forces Service Medal may be awarded to members of the Armed Forces of the United States for operations for which no other U.S. campaign or service medal is approved. It is intended for service members who, after 1 June 1992, participate or have participated as members of U.S. military units in a U.S. military operation deemed to be a significant activity, and encounter no foreign-armed opposition or imminent threat of hostile action. This includes peacekeeping operations. c. The Global War on Terrorism Expeditionary Medal is authorized for award to members of the Armed Forces of the United States who deployed abroad for service in Global War on Terrorism operations on or after 11 September 2001 to a date to be determined. Initial award was limited to service members deployed abroad in Operations Enduring Freedom and Iraqi Freedom in designated specific geographic areas of eligibility, to include Afghanistan and Bosnia-Herzegovina. d. The Global War on Terrorism Service Medal is authorized for award to members of the Armed Forces of the United States who have participated in Global War on Terrorism operations outside of the areas of eligibility designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraq Campaign Medal. All Soldiers on active duty, including Reserve Component Soldiers mobilized or National Guard Soldiers activated, on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized this award. e. The Afghanistan Campaign Medal is awarded to members who have served in direct support of Operation Enduring Freedom (OEF). The area of eligibility encompasses all the land area of the country of Afghanistan and all air spaces above the land area. The period of eligibility is on or after 11 September 2001 to a future date to be determined by the Secretary of Defense or the cessation of OEF. (1) A bronze service star is authorized for wear with this medal for participation in each credited campaign. (2) Approved designated Afghanistan campaigns include Consolidation I (1 December 2001-30 September 2006). (3) Under no condition will personnel receive the Afghanistan Campaign Medal, Global War on Terrorism Expeditionary Medal, the Global War on Terrorism Service Medal, the Iraq Campaign Medal, or the Armed Forces Expeditionary Medal for the same period of service. f. The Iraq Campaign Medal is awarded to members who served in direct support of Operation Iraqi Freedom. The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 through 31 December 2011. Service members must have been assigned to units operating in the area of eligibility for 30 consecutive days, or for 60 nonconsecutive days. A bronze service star is authorized for wear with this medal for participation in each credited campaign. Included among the approved campaigns is Transition of Iraq (2 May 2003-28 June 2004). 2. AR 635-5 (Personnel Separations - Separation Documents), in effect at the time, prescribed policies and procedures for the completion of DD Form 214. Item 12f will show all foreign service completed during the period covered by the DD Form 214. Item 18 for an active duty Soldier deployed to a foreign country with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)." DISCUSSION: 1. The applicant requests that his combat service in Grenada be reflected on his DD Form 214 for the period ending 31 May 2009. The evidence of record shows he was deployed to Grenada from on or about 25 October to 4 November 1983. Based on this, it would be appropriate to amend his DD Form 214 to show this deployment period. 2. With regard to awards for his service in Grenada, the available record does not provide specific details as to which awards resulted from what deployment. His awards, however, appear to be associated as follows: * Armed Forces Expeditionary Medal - Grenada * Armed Forces Service Medal - Bosnia * Global War on Terrorism Expeditionary Medal - Afghanistan * Iraq Campaign Medal - Iraq 3. The regulatory guidance precludes awarding more than one of the above-cited awards for a given period of service. 4.
