Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests adjustment of his date of rank (DOR) to captain (CPT). 2. The applicant states: a. He requests correction of his original direct commissioning DOR derived from an incorrect constructive credit calculation on his DA Form 5074-R (Record of Award of Entry Grade Credit (Medical and Dental Officers)). b. His DA Form 5074-R, dated 28 October 2011, entered an incorrect licensure date which yields a constructive credit calculation of 19 years and 9 months for professional experience for a DOR of 28 October 2008 and rank of CPT. c. His DA Form 5074-1-R (Record of Award of Entry Grade Credit (Health Services Officers)), dated 18 November 2011, shows the correct licensure date, resulting in 20 years and 3 months of credit for professional experience, but still results in a DOR of 28 October 2008. d. This error of 6 months has negatively impacted his military career time line. The mistake clouds over the 20-plus years of experience he had in his area of concentration 63A (general dentist) at that time, and that he managed five to nine employees in his own private practice during that time. It also omits that he spent 10 years as an assistant professor of operative dentistry at a major university while still maintaining his private practice, and ignores that he had over 850-plus hours of continuing education and completed a fellowship in advanced dental training, all qualifications which should have enhanced his direct commissioning position. 3. The applicant provides: * DA Form 5074-R, dated 28 October 2011 * DA Form 5074-1-R, dated 18 November 2011 * dentistry license, dated 3 July 1991 CONSIDERATION OF EVIDENCE: 1. The applicant was appointed as a CPT in the Army National Guard in the Dental Corps on 28 October 2011 with a DOR of 28 October 2011. 2. He provided a DA Form 5074-R, dated 28 October 2011, showing he received 4 years of constructive credit for his basic qualifying degree and 3 years of constructive credit for professional experience for the period 2 January 1992 to 18 October 2011. His total entry-grade credit was 7 years for the rank of CPT. 3. He also provided a DA Form 5074-1-R, dated 18 November 2011, showing he received 4 years of constructive credit for his basic qualifying degree and 3 years of constructive credit for professional experience for the period 3 July 1991 to 27 October 2011. His total entry-grade credit was 7 years with a DOR to CPT of 28 October 2008. 4. He was promoted to major effective 1 June 2015 with a DOR of 1 June 2015. 5. In the processing of this case, an advisory opinion was obtained from the U.S. Army Recruiting Command, Fort Knox, KY, dated 16 March 2016. The opinion states: a. After careful review of the applicant's records, that office determined that his date of initial licensure as shown in item 22 of the DA Form 5074, dated 28 October 2011, is incorrect. A corrected DA Form 5074 was provided. b. This correction will have no effect on the applicant's DOR. c. Department of Defense Instruction (DODI) 6000.13 (Medical Manpower and Personnel), section 6.1.2.2.5, states credit of 1/2 year is awarded for each year of experience, up to a maximum of 3 years. The applicant received the maximum credit of 3 years for his professional experience from 3 July 1991 to 18 October 2011. 6. The corrected DA Form 5074-R, dated 16 March 2016, shows he was credited with 4 years of constructive credit for his basic qualifying degree and 3 years of constructive credit for professional experience from 3 July 1991 to 18 October 2011. 7. A copy of the advisory opinion was forwarded to the applicant for his information and to allow him the opportunity to submit comment or a rebuttal. He did not respond. REFERENCES: 1. DODI 6000.13, section 6.1.2.2.5, states credit of 1/2 year is awarded for each year of experience, up to a maximum of 3 years. 2. Army Regulation 135-101 (Appointment of Reserve Commissioned Officers for Assignment to Army Medical Department (AMEDD) Branches) provides policy for the appointment of Reserve commissioned officers for assignment to AMEDD branches. Chapter 3 provides that grade and DOR upon original appointment and assignment to an AMEDD branch will be determined by the number of years of entry-grade credit awarded. Except as limited by maximum credit limits, entry-grade credit granted will be the sum of constructive service credit and the credit for prior active commissioned service. 3. Army Regulation 135-101 states the appointment grade of an individual with entry-grade credit of 7 years or more but less than 14 years is CPT. DISCUSSION: 1. The applicant requests adjustment of his DOR to CPT based on an incorrect constructive credit calculation for his professional experience. 2. DODI 6000.13 states credit of 1/2 year is awarded for each year of work experience, up to a maximum of 3 years. 3. The evidence of record shows he received the maximum credit of 3 years for his professional experience from 3 July 1991 to 18 October 2011. 4.
