Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the social security number (SSN) on his DD Form 214 (Report of Separation from Active Duty). 2. The applicant states his correct SSN is x5x-XX-XXXX. He is homeless and needs to have this correction made in order to receive housing assistance and related services. 3. The applicant provides: * DD Form 214 * a letter from Volunteers of America * social security card * Social Security Administration (SSA) benefits statement * SSA benefits letter CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant served in the Regular Army from 28 October 1966 through 8 July 1970 with service in Vietnam from 25 May 1967 through 27 May 1968. 3. His official record contains a DA Form 20 (Enlisted Qualification Record) showing his SSN as x5x-XX-XXXX on page one and x8x-XX-XXXX on the DA Form 20B insert. Unit Orders Number 7 issued by 561st Transportation Company (Terminal Service) on 25 January 1968 lists his SSN as x5x-XX-XXXX. 4. The applicant’s 1970 DD Form 214 lists his SSN as x8x-XX-XXXX. 5. The social security card and letters provided by the applicant as evidence to support his application show his SSN as x5x-XX-XXXX. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The regulation stated the purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. It is important that information entered on the form be complete and accurate and reflects the conditions as they existed at the time of separation. Verification of the SSN is taken from the Soldier's DA Form 20. DISCUSSION: The SSN shown on the applicant's social security card was recorded in his military records. The evidence indicates a transcription error led to the entry of an incorrect SSN on his DD Form 214. //NOTHING FOLLOWS//
