Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show he was awarded a Certificate of Special Congressional Recognition. He also requests he be provided with the medal. 2. The applicant states he received delayed recognition from Congress for his involvement in a classified program. Program operations were restricted until information was released to the media. 3. The applicant provides copies of his DD Form 214 and the Certificate of Special Congressional Recognition, dated 26 September 1998. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's military service records are not available to the Board for review. However, the documents the applicant provided are sufficient for the Board to conduct a fair and impartial review of this case. 3. The applicant was inducted on 16 December 1954. He held military occupational specialty 922.10 (Physical Reconditioning Specialist). 4. He was honorably discharged on 14 December 1956 as a specialist 3rd class/pay grade E-3. He completed 1 year, 11 months, and 29 days of total active service. His DD Form 214 shows no foreign service. Item 26 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) shows the Good Conduct Medal. 5. He provides a Certificate of Special Congressional Recognition, dated 26 September 1998, that shows he was recognized for outstanding and invaluable service to the country. REFERENCES: Army Regulation 635-8 (Separation Processing and Documents) establishes the standardized policy for preparing and distributing the DD Form 214. It is important that information entered on the form should be complete and accurate. The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. DISCUSSION: The applicant's Certificate of Special Congressional Recognition is dated 26 September 1998; which is well after his period of active duty. There is no known medal to accompany this certificate.
