Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) and his DD Form 215 (Correction to DD Form 214) to show his social security number (SSN) as . 2. He also request the transfer of the awards listed on his DD Form 215 to his DD Form 214. 3. He states his SSN is incorrect. 4. He provides his discharge certificate, DD Form 214, DD Form 215, and his social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. As part of his induction processing, the applicant completed a DD Form 398 (Statement of Personal History). He listed the SSN shown on the social security card he provided. 3. He was inducted into the Army of the United States on 29 November 1965 and he was released from active duty on 8 November 1967. His DD Form 214 lists an SSN that is different from the SSN listed on his social security card. 4. A DD Form 215, issued on 11 October 2013, corrects his DD Form 214 listed above to include additional awards. The SSN listed on the DD Form 215 is the same SSN listed on his DD Form 214. REFERENCES: 1. Army Regulation 635-5 (Separation Documents), then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provided a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. 2. The current version of this same regulation states that a DD Form 214 may be reissued only when: a. directed by proper appellate authority, Executive Order, or by the Secretary of the Army; b. it is determined that the corrections to be made will not fit within the correction block of a single DD Form 215; or c. two DD Forms 215 have been issued and an additional correction is required. DISCUSSION: 1. The applicant requests correction to his DD Form 214 to show the SSN that is listed on his social security card and all of his authorized awards (as shown on his DD Form 215). 2. His DD Form 398 shows the SSN that is listed on the social security card he provided, which is also the SSN listed throughout his OMPF. His DD Form 214 contains an administrative error. 3. The purpose of the DD Form 215 is to correct the DD Form 214. As such; there is no requirement to physically correct the DD Form 214.
