THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the: * Afghanistan Campaign Medal * Global War on Terrorism Service Medal * all other eligible awards 2. The applicant states some of the medals were issued after her release from active duty. 3. The applicant provides her DD Form 214 with an ending date of 8 January 2003. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. With prior service in the Regular Army and U.S. Army Reserve (USAR), the applicant reenlisted in the USAR on 16 January 2001. She held military occupational specialty 56M (Chaplain Assistant). 3. She was ordered to active duty on 14 May 2002 in support of Operation Enduring Freedom (OEF) and served in Afghanistan from 24 June 2002 to 10 December 2002. 4. She was honorably released from active duty on 8 January 2003. The DD Form 214 she was issued shows in: * Item 12f (Foreign service) – "0000-00-00" * Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) – * Army Commendation Medal (6th Award) * Army Achievement Medal (5th Award) * Army Good Conduct Medal (4th Award) * National Defense Service Medal (2nd Award) * Armed Forces Reserve Medal * Armed Forces Reserve Medal with "M" Device (2nd Award) * NCO Professional Development Ribbon * Army Service Ribbon * Overseas Service Ribbon (2nd Award) * Item 18 (Remarks), in part, the entry "Service in Afghanistan 20020604 to 20021210" REFERENCE: 1. Army Regulation 600-8-22 (Military Awards) provides Department of the Army policy, criteria, and administrative instructions concerning individual military decorations, Army Good Conduct Medal, service medals and ribbons, combat and special skill badges and tabs, unit decorations, and trophies, and similar devices awarded in recognition of accomplishments. It states: a. The Afghanistan Campaign Medal is awarded to members who have served in direct support of OEF. The area of eligibility (AOE) encompasses all the land area of the country of Afghanistan and all air spaces above the land area. The period of eligibility is on or after 11 September 2001 to a future date to be determined by the Secretary of Defense or the cessation of OEF. A bronze service star is authorized for wear with this medal for participation in each credited campaign. Approved designated Afghanistan campaigns include the Consolidation I (1 December 2001-30 September 2006) campaign. b. The Global War on Terrorism Expeditionary Medal is awarded to members assigned, attached, or mobilized to a unit participating in designated operations for 30 consecutive days or 60 nonconsecutive days in the AOE, or meet other, specified criteria. Initial award of the Global War on Terrorism Expeditionary Medal was limited to members deployed abroad in OEF and Operation Iraqi Freedom (OIF) in designated specific geographic AOE, including Afghanistan. c. Service members qualified for the Global War on Terrorism Expeditionary Medal by reason of service between 24 October 2001 and 28 February 2005, in an area for which the Afghanistan Campaign Medal was subsequently authorized, will remain qualified for that medal. Upon application, any such service member may be awarded the Afghanistan Campaign Medal in lieu of the Global War on Terrorism Expeditionary Medal for such service. No service member will be entitled to both medals for the same act, achievement, or period of service. d. The Global War on Terrorism Service Medal is authorized for award to members of the Armed Forces of the United States who have participated in the Global War on Terrorism operations outside of the designated AOE on or after 11 September 2001 to a future date to be determined. All Soldiers on active duty, on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the Global War on Terrorism Service Medal. 2. Army Regulation 635-5 (Personnel Separations – Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon their retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It states for: * item 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214 * item 13, enter awards and decorations from all periods DISCUSSION AND CONCLUSIONS: 1. The applicant served in Afghanistan from 24 June to 10 December 2002, a period of 5 months and 17 days in support of OEF. This foreign service is not reflected in item 12f of her DD Form 214. 2. She served during a qualifying period of service in Afghanistan for award of the Afghanistan Campaign Medal. Based on her service there, she is entitled to one bronze service star for wear on her Afghanistan Campaign Medal. Her DD Form 214 does not show this award. 3. She served during a qualifying period of service for award of the Global War Global War on Terrorism Service Medal.
