Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant, the widow of a deceased former service member (FSM), requests reconsideration of her earlier request for correction of her late husband's DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as through a Member of Congress. 2. The applicant states her late husband's SSN is incorrect in his military records. 3. The applicant provides no additional evidence; however, a Member of Congress sent a letter to the Department of the Army Office of the Chief, Legislative Liaison, dated 13 July 2015, on behalf of the applicant. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20140012888 on 10 March 2015. 2. The letter from a Member of Congress, dated 13 July 2015, is new evidence that was not previously considered by the Board and warrants consideration at this time. 3. The FSM was inducted into the Army of the United States on 2 June 1965. At that time, he was assigned an Army service number. 4. His military records contain the following documents bearing his signature showing his SSN as: * DA Form 41 (Record of Emergency Data), dated 21 April 1966 * DA Form 20 (Enlisted Qualification Record) 5. On 12 May 1967, he was honorably released from active duty and transferred to the U.S. Army Reserve Control Group (Annual Training) to complete his military service obligation. Item 3 (SSN) of his DD Form 214 shows his SSN as . 6. His military records contain a U.S. Army Administration Center Form 170, dated 25 November 1967, showing his SSN as and indicating the following entries in his records required correction: * Selective Service Number * Retirement Anniversary Date * Job Description and Title * Expiration Term of Service 7. His military records contain U.S. Army Administration Center Letter Orders Number 05-1090205, dated 26 May 1971, discharging him from the U.S. Army Reserve Control Group (Standby) effective 1 June 1971. These orders show his SSN as . 8. The FSM's available military records do not contain a DA Form 2139 (Military Pay Voucher). 9. There is no evidence in the FSM's available military records showing his SSN was recorded as at any time during his military service. 10. On 10 March 2015, the ABCMR denied the applicant's request to correct the SSN shown on the FSM's DD Form 214 because she failed to provide evidence showing the requested SSN was ever used by the FSM during his military service. In support of her claim, the applicant provided the FSM's death certificate and Fieldcrest Cannon, Incorporated, Medical Benefits Plan Identification card, showing his SSN as . 11. The letter from a Member of Congress to the Department of the Army Office of the Chief, Legislative Liaison, dated 13 July 2015, on behalf of the applicant states he has a strong interest in the facts surrounding this matter and requests a review of this issue and a copy of the findings and conclusions. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The instructions stated to transcribe the SSN from the individual's DA Form 2139. DISCUSSION: 1. The applicant contends the SSN shown on the FSM's DD Form 214 is incorrect. 2. His DA Form 41 shows the SSN was recorded on his Record of Emergency Data in April 1966 during his term of active military service. His DD Form 214 shows this same SSN. 3. The FSM's available military records do not contain a DA Form 2139 and there is no evidence showing his SSN was recorded as at any time during his military service. 4. For historical purposes, the Army has an interest in maintaining the integrity of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created. In the absence of a showing of material error or injustice, there is a reluctance to recommend that those records be changed. While it is understandable that the applicant now desires to record the SSN shown on the FSM's death certificate and medical identification card on his DD Form 214, there is not a sufficiently compelling reason for compromising the integrity of the Army's records at this late date. 5. The applicant is advised that a copy of this decisional document will be filed in the FSM's military records.
