THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his social security number (SSN) on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) with an effective date of 30 August 1967. 2. The applicant states his correct SSN is XXX-XX-XxXX. 3. The applicant provides: * social security card * DD Form 214 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 31 August 1964, he enlisted in the Regular Army for 3 years. His DD Form 4 (Enlistment Record - Armed Forces of the United States) does not show a SSN. He was assigned an Army service number (ASN) as the primary source of identification. 3. Item 7 (SSN) of the applicant's DA Form 41 (Record of Emergency Data), prepared on 15 March 1966, shows his SSN as XXX-XX-XxXX. There are no other documents in the applicant's Military Personnel Records Jacket (MPRJ) showing his SSN. There is no DA Form 2139 (Military Pay Voucher) in his MPRJ. 4. On 30 August 1967, the applicant was honorably released from active duty. Item 3 (SSN) of his DD Form 214 shows his SSN as XXX-XX-XxXX. 5. The applicant provided his social security card that shows his SSN as XXX-XX-XxXX. REFERENCES: 1. During the period the applicant served on active duty, Soldiers were identified by their ASN. In accordance with a directive from the Office of the Secretary of Defense, the Army discontinued using the ASN as an identifier and began using the SSN on 1 July 1969. 2. Army Regulation 635-5 (Separation Documents), effective 23 January 1967, states the SSN in item 3 of the DD Form 214 was transcribed from the Soldier's DA Form 2139. DISCUSSION: 1. During the period of the applicant's service Soldiers were identified by their ASN. The applicant's DA Form 41 shows his SSN as XXX-XX-XxXX. There are no other documents in his MPRJ showing his SSN. There is no DA Form 2139 in his MPRJ. 2. The applicant’s DD Form 214 should be corrected to show his SSN as shown on his social security card and DA Form 41. //NOTHING FOLLOWS//
