The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. item 11, adding “D3” immediately after the five characters of his MOSC; and b. item 13, deleting Iraq Campaign Medal with campaign star and adding Iraq Campaign Medal with two bronze service stars. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) by showing: * date of entry on active duty as 24 September 2007 * completion of the Air Assault Course and award of the Air Assault Badge * completion of the Combat Life Saver Course * award of the Army Good Conduct Medal (AGCM) * award of the Iraq Campaign Medal with two bronze service stars * additional skill identifiers (ASIs) of D3 and 2C 2. The applicant states he discovered these errors on the day of his discharge; but, the clerk would not make the corrections because it would have delayed the date of his discharge. He discussed these issues with his Department of Veteran Affairs counselor (VA), who advised him to submit this request for correction. 3. The applicant provides copies of: * DD Form 4/1 and 4/2, dated 29 September 2007 (3 pages) * Military Personnel (MILPER) Message Number 11-342, dated 3 November 2011 (2 pages) * A Verification of Military Experience and Training, undated (2 of 5 pages) CONSIDERATION OF EVIDENCE: 1. A DD Form 4/1 and DD Form 4/2 (Enlistment/Reenlistment Document – Armed Forces of the U.S.), dated 24 September 2007, as provided by the applicant, shows he enlisted in the U.S. Army Reserve (USAR) for a period of 8 years, as a cadet. 2. The DD Form 4/2, dated 24 September 2007, also shows that a lieutenant colonel, pay grade O-5 enlisted the applicant into the USAR at the University of Cincinnati, Ohio, as a member of the Army Reserve Officer Training Corps (ROTC). 3. A DA Form 3286 (Statement of Understanding) dated 13 May 2009, shows the applicant reserved an enlistment option 9B for U.S. Army Station/ Unit/ Area/ Command Enlistment Program. He acknowledged he was scheduled for enlistment into the Regular Army on 18 May 2009. 4. A DD Form 1966/1 and DD Form 1966/2 (Record of Military Processing – Armed Forces of the U.S.) show the applicant was accessed into the Regular Army on 18 May 2009 for a period of 3 years, as a private in pay grade E-1. 5. The DD Form 1966/2 also shows the applicant attended the University of Cincinnati from September 2007 to December 2008. 6. A DA Form 3340 (Request for Reenlistment or Extension in the Regular Army), dated 14 December 2010, indicates that the applicant’s request to reenlist in the active component was approved. 7. A DD Form 4/1 and 4/2, dated 17 December 2010, show the applicant reenlisted in the Regular Army for 5 years beginning in the rank of specialist, pay grade E-4. 8. The applicant?s DD Form 214 shows: a. he enlisted in the Regular Army on 18 May 2009 and was discharged on 18 April 2014 under the provisions of Army Regulation 635-200, chapter 18, due to weight control failure; b. he completed 4 years, 11 months, and 1 day of creditable active duty service; c. his awards include: * Army Commendation Medal (ARCOM) * Meritorious Unit Commendation (MUC) * National Defense Service Medal (NDSM) * Global War on Terrorism Service Medal (GWOTSM) * Iraq Campaign Medal with Campaign Star (ICM –CS(1)) * Army Service Ribbon (ASR) * Overseas Service Ribbon (OSR) * Driver and Mechanic Badge with Driver-W Clasp (DMB-DWV) d. The applicant completed the following military training: * Pashto Basic Language Instruction Course, 12 weeks, 2012 * Unit Armorer Course, 2 weeks, 2011 e. The applicant served in Iraq from 31 December 2009 to 19 October 2010. 9. His Enlisted Record Brief (ERB), dated 21 April 2014, indicates: a. he entered the military as a Reservist on 24 September 2007; b. he entered active duty on 18 May 2009; c. he held MOS 19D effective November 2009 with ASI of D3 and B9; d. he completed the Unit Armorer Course and Pashto language training; e. he completed 88 hours of training by correspondence (unspecified); and f. his awards and decorations include: * ARCOM * MUC * NDSM * ICM-CS (2) * GWTSM * ASR * OSR * DMB-DWV 10. The MILPER Message Number 11-342, as provided by the applicant, indicates that the Iraqi Sovereignty Campaign was from 1 January 2009 to 31 August 2010 and the New Dawn Campaign was from 1 September 2010 to a date to be determined. 11. The 2 pages of the Verification of Military Experience and Training, as provided by the applicant, do not show that these pages are related to the applicant in that there is no name, service number, or other identifying data to clearly show that the data therein pertains to the applicant. REFERENCES: 1. Army Regulation 635-8 (Separation Processing and Documents) prescribes policy and procedural guidance relating to transition management. It consolidates the policies, principles of support, and standard of service regarding processing personnel for transition. Paragraph 5-6 provides specific rules and detailed instructions for completing the DD Form 214: a. Block 11 (Primary Specialty): Enter the titles of all MOSs or areas of concentration (AOCs) awarded and held for at least 1 year during the current period of service and include for each MOS/AOC the number of years and months held. For time determinations, 16 or more days counts as a month. Do not count time in training (basic training, advanced individual training, basic officer?s leader course, or MOS-producing school). For enlisted Soldiers, specify the first five characters of the MOS code (MOSC) which includes three characters of the MOS, the fourth character of skill and grade level in each MOS, and the fifth character of a special qualification identifier (SQI), if applicable. Enter ?O? when not applicable. A single ASI may be listed immediately following the five-character MOSC. b. Block 12a (Date Entered Active Duty this Period): Data sources are enlistment contract(s), initial order to active duty, active duty order, previously issued DD Forms 214, DA Form 1506 (Statement of Service) and a complete review of the Soldier’s official record. Enter the beginning date of the continuous period of active duty for issuance of this DD Form 214, for which a DD Form 214 was not previously issued. Do not depend on a basic active service date for this item because it could be an adjusted date. c. Block 14 (Military Education): Enter all formal, in-service training courses successfully completed during the period of the service covered by the DD Form 214, of at least 1 week or 40 hours duration. This information is to assist the Solder in job placement and counseling; therefore, do not list training courses for combat skills. Acceptable source documents include the ERB, DA Form 4037 (Officer Record Brief), DA Form 1059 (Service School Academic Evaluation Report), or other military issued certificate of completion with from and through dates of the course identified and the number of weeks of the course. 2. Army Regulation 600-8-22 (Military Awards) a. The Air Assault Badge requires satisfactory completion of an air assault training course according to the U.S. Army Training and Doctrine Command standardized Air Assault Core Program of Instruction, or completion of the standard Air Assault Course while assigned or attached to the 101st Airborne Division (Air Assault) after 1 April 1974. b. The AGCM is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified. Completion of 3 years of Active Federal Service, on or after 27 August 1940, normally qualifies for award; accept for the first award, which may be issued with as little as 1 year. c. The ICM is awarded to members who have served in direct support of Operation Iraqi Freedom (OIF). The ICM period of eligibility is on or after 19 March 2003 through 31 December 2011. A bronze service star is authorized for wear with this medal for participation in each credited campaign. Approved campaigns include: * Iraqi Sovereignty (1 January 2009 - 31 August 2010) * New Dawn (1 September 2010 - 31 December 2011) DISCUSSION: 1. The applicant contends his DD Form 214 should be corrected by showing: * date of entry on active duty as 24 September 2007 * completion of the Air Assault Course and award of the Air Assault Badge * completion of the Combat Life Saver Course * award of the AGCM * award of the ICM with two bronze service stars * ASIs of D3 and 2C 2. The available evidence shows the applicant enlisted in the USAR on 24 September 2007 while at the University of Cincinnati as a member of the ROTC. 3. The applicant enlisted in the Regular Army on 18 May 2009. This date is in agreement with the date currently shown on his DD Form 214. 4. The applicant was awarded MOS 19D1O with ASI D3 and B9. The governing regulation permits entry of one ASI immediately following the MOSC. As D3 is one of the two ASI the applicant’s asked to have added to his DD Form 214, it would be appropriate to add this ASI. 5. There is no documentary evidence in the applicant’s military records showing he successfully completed the Air Assault Course or the Combat Life Saver Course. Furthermore, there are no orders showing he was awarded the Air Assault Badge. The Verification of Military Experience and Training excerpts he provided do not contain his name or other personally identifiable information verifying it as his record. 6. The applicant continually served on active duty for a period of 4 years, 11 months, and 1 day. He completed 3 years of active duty on 17 May 2012. A review of the available records show that he received a personal decoration and attained the rank of specialist, pay grade E-4. However, it also shows that he was discharged because he did not maintain an acceptable body weight. His discharge was about 2 years after he had completed the required minimum time for award of the AGCM. This was more than sufficient time for him to have addressed this issue with his commander and received an Army Good Conduct Medal, if that was his commander’s intent. 7. The available evidence shows the applicant served in Iraq during two campaign periods.
