Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) to show his social security number (SSN) as . 2. The applicant states his SSN is listed incorrectly on his DD Form 214. 3. The applicant provides his DD Form 214 and social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army (RA) on 17 February 1976. His DD Form 4 (Enlistment or Reenlistment Agreement - Armed Forces of the United States), dated 17 February 1976, shows his SSN with the first three digits as . 3. His DA Form 2-1 (Personnel Qualification Record) created upon his entry on active duty shows his SSN with the first three digits as . His records contain numerous documents that show his SSN with the first three digits as . 4. On 16 June 1978, by memorandum, his senior commander approved a Bar to Reenlistment Certificate to be placed against the applicant. He stated the bar to reenlistment would be reviewed 6 months after the date of approval. This memorandum lists the applicant's SSN with the first three digits as . 5. An automated DA Form 2-1, prepared on 7 October 1978, shows his SSN with the first three digits as . His DA Form 2-1 that was created upon his entry on active duty was subsequently corrected by crossing out his SSN with the first three digits as 344 and reentering it with the first three digits as . 6. On 11 December 1978, by memorandum, his immediate commander stated he reviewed the bar to reenlistment and recommended the bar be continued. This memorandum lists the applicant's SSN with the first three digits as . 7. He was honorably released from active duty on 14 February 1979 and he was transferred to the U.S. Army Reserve. Item 3 (SSN) of the DD Form 214 he was issued shows his SSN with the first three digits as 344. 8. The applicant provides his social security card wherein his SSN is listed with the first three digits as . DISCUSSION: The evidence of record confirms the applicant's SSN was listed with the first three digits as 344 upon his enlistment in the RA. This is the SSN that was used throughout much of his military service. However, records shows his SSN was listed with the first three digits as in June 1978 and an automated DA Form 2-1 was prepared on 7 October 1978 that listed his SSN with the first three digits as . It appears an error may have occurred during his enlistment processing and his SSN was inadvertently listed with the first three digits as 344 on his DD Form 4. //NOTHING FOLLOWS// AB
