BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by replacing the entries in items 4a and 4b of his DD Form 214 with the entries “SGT” and “E05” and replacing the entry in item 12i with "2015  02  27."

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction to his records to show he was promoted to the rank/grade of sergeant (SGT)/E-5 prior to his separation.

2.  The applicant states he was promoted from specialist (SPC) to SGT and has provided a copy of his promotion orders.  He would like his DD Form 214 (Certificate of Release or Discharge from Active Duty) to reflect the same rank/grade.

3.  The applicant provides Orders 055-01, issued by Headquarters, 101st Sustainment Brigade, Fort Campbell KY, dated 24 February 2015, and 
DD Forms 214.
 
CONSIDERATION OF EVIDENCE:

1.  On 19 August 2008, the applicant enlisted in the Regular Army (RA).

2.  He was promoted to SPC/E-4 on 1 May 2010.  On 15 December 2011, he was honorably released from active duty.  

3.  On 12 September 2012, the applicant enlisted in the RA in the rank/grade SPC/E-4.   

4.  The applicant provides Orders 055-01, issued by Headquarters, 101st Sustainment Brigade, Fort Campbell, KY, dated 24 February 2015, that show he was promoted to SGT/E-5 with an effective date of 27 February 2015. 

5.  On 27 February 2015, the applicant was retired for physical disability and transferred to the Temporary Disability Retired List (TDRL).  Items 4a (Grade, Rate or Rank) and 4b (Pay Grade) of his DD Form 214 show his rank/pay grade as SPC/E-4.  Item 12i (Effective Date of Pay Grade) shows the entry 1 May 2010.

REFERENCES:

1.  Army Regulation 600-8-19 (Enlisted Promotions and Reductions), in effect at the time, prescribed the policies and procedures for the promotion and reduction of enlisted Soldiers.  It states, in part, that a Soldier who is on a promotion list prior to retirement for physical disability will be promoted to the promotion list grade effective the day prior to being transferred to the Retired List.  

2.  Army Regulation 635-8 (Separation Procession and Documents) establishes the standardized policy for preparing and distributing the DD Form 214.  Items 4a (Grade, Rate or Rank) and 4b (Pay Grade) show the rank/grade in which a member was serving at the time of separation and item 12i (Effective Date of Pay Grade) shows the date of rank for the grade shown in item 4a.

DISCUSSION:

1.  The applicant requests correction to his DD Form 214 to show he was promoted to the rank/grade of SGT/E-5 prior to his separation.  

2.  The governing regulation provides that items 4a and 4b of the DD Form 214 will show the active duty rank and pay grade at the time of the Soldier's separation; the rank is taken from the Soldier's promotion/reduction orders.

3.  Order show he was promoted to sergeant (SGT)/E-5 with an effective date of 27 February 2015, the day prior to his transfer to the TDRL.
