Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the social security number (SSN), place of birth (POB), and military occupational specialty (MOS) number and title that are recorded on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). 2. The applicant states that he served in Vietnam with the 611th Transportation Company and the unit only had UH-1 (Huey) helicopters. He adds that his DD Form 214 should be corrected, as follows: * item 3 (SSN): "3XX-XX-XXXX" instead of "5XX-XX-XXXX" * item 8 (POB): "" instead of "" * item 23a (Specialty Number and Title): "67N2O [UH-1 Helicopter Repairer] "Single Engine Single Rotor Light Helicopter Crew Chief" instead of "67B2O, Bridge Specialist" 3. The applicant provides copies of his Certificate of Birth; social security card; DA Form 20 (Enlisted Qualification Record), pages 1 and 3; and DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. A DD Form 398 (Statement of Personal History), prepared by the applicant on 28 October 1966, in pertinent part, shows he entered in: * item 5 (POB): "" * item 13 (Employment), SSN: "3XX-XX-XXXX" 3. The applicant was inducted into the U.S. Army on 2 November 1966. a. At the time the applicant enlisted, the U.S. Armed Forces did not use the SSN for identification. The applicant's DA Form 20, in pertinent part, shows in: * item 1 (Name and Service Number): "3XX-XX-XXXX" * item 20 (Birthplace and Citizenship): "" * item 22 (MOS – Code, Title, Date) and item 45 (Item Continuation) – * 67A10, Aircraft Maintenance Crewman, 22 March 1967 (lined-thru) * 67S2O, Single Engine Tandem Rotor Helicopter Mechanic, 2 May 1967 (lined-thru) * 67P3O, Single Engine Single Rotor Utility Light Transport Helicopter, 9 May 1967 (lined-thru) * 67K2O, Multi-Engine Repairman, 29 May 1967 (lined-thru) * 67B2O, O-1 U-6 Airplane Repairman, 19 May 1968 * item 27 (Military Education – Title of Course, MOS Code, Year) : * Aircraft Maintenance Crewman, 67A1O, 1967 * Single Engine Tandem Rotor Helicopter Maintenance, 67S2O, 1967 * item 38 (Record of Assignment): Duty MOS 67G2O, Single Engine Single Rotor, Light Helicopter Crew Chief, 611st Transportation Company (Aircraft Direct Support), from 30 March 1968 through 17 October 1968 5. Headquarters, 765th Transportation Battalion (Airmobile and Support), Special Orders Number 130, dated 19 May 1968, announced the following MOS actions pertaining to the applicant: * withdrawal of Primary MOS 67K20 * withdrawal of Secondary MOS 67P3O * award of Primary MOS 67B2O 6. An Affidavit, dated 21 October 1968, completed by the applicant at Headquarters, U.S. Army Transfer Station, U.S. Army Personnel Center, Oakland, CA, in pertinent part, shows the entry for his POB as "West Branch, Missouri" and that the applicant signed the affidavit. 7. A DD Form 214 shows the applicant entered active duty on 2 November 1966, was honorably released from active duty (REFRAD) on 21 October 1968, and transferred to the U.S. Army Reserve (USAR) Control Group (Annual) to complete his Reserve obligation. He had completed 1 year, 11 months, and 20 days of net active service this period that included 6 months and 27 days of foreign service. It also shows in: * item 3: "5XX-XX-XXXX" * item 8: "" * item 12 (Last Duty Assignment – Major Command): 611th Transportation Company (Aircraft Direct Support), U.S. Army Pacific * item 23a: "67B2O, BRIDGE SPEC" 8. USAR Components Personnel and Administration Center, St. Louis, MO, Letter Orders Number 10-1433286, dated 18 October 1972, honorably discharged the applicant from the USAR Control Group (Standby), effective 1 November 1972. The orders show his SSN as "3XX-XX-XXXX" and his MOS as "67B2O." 9. In support of his application the applicant provides copies of the following additional documents: * Social Security card that shows he was issued SSN "3XX-XX-XXXX" * State of , Certificate of Birth, Department of Health, Bureau of Records and Statistics, that shows the applicant's POB was in the town of "" and County of "" [] REFERENCES: Army Regulation 635-5 (Personnel Separations - Separation Documents), in effect at the time of the applicant's separation from active duty, prescribed policies and procedures regarding separation documents. It also established standardized policy for preparing and distributing the DD Form 214. Section III (Instructions for Preparation and Distribution of the Armed Forces of the United States Report of Transfer or Discharge) states, in pertinent part, that all available records will be used as a basis for the preparation of the DD Form 214, including the Enlisted Qualification Record, Officer Qualification Record, and orders. The instructions show for: * item 3, transcribe SSN from DA Form 2139 (Military Pay Voucher) * item 8: self-explanatory * item 23a: enter primary MOS code and title DISCUSSION: 1. The evidence of record shows the applicant's correct SSN and correct POB were entered in his military service records during the period of his active duty. a. It appears that during his separation processing (on 21 October 1968) an administrative error occurred resulting in the incorrect listing of his SSN and his POB when he was REFRAD. b. Based on the evidence of record it would be appropriate to correct the applicant's DD Form 214 to show his correct SSN as shown on his social security card and his correct POB as shown on his certificate of birth. 2. The evidence of record shows the applicant completed training in MOS 67A1O (Aircraft Maintenance Crewman) and in MOS 67S2O (Single Engine Tandem Rotor Helicopter Maintenance). a. The evidence of record also shows he was awarded MOS 67A10 (Aircraft Maintenance Crewman) on 22 March 1967; MOS 67S2O (Single Engine Tandem Rotor Helicopter Mechanic) on 2 May 1967; MOS 67P3O (Single Engine Single Rotor Utility Light Transport Helicopter) on 9 May 1967; and MOS 67K2O (Multi-Engine Repairman) on 29 May 1967. b. On 19 May 1968, special orders awarded the applicant Primary MOS 67B2O (O-1 U-6 Airplane Repairman) and his previously awarded MOSs were withdrawn. c. There is no evidence of record that shows the applicant was awarded MOS 67N2O (UH-1 Helicopter Repairer). d. Item 23a of the applicant's DD Form 214, issued on 21 October 1968, shows the entry "67B2O BRIDGE SPEC."
