THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the issuance of a DD Form 214 (Certificate of Release or Discharge from Active Duty) for her U.S. Army Reserve (USAR) service from 2009 to 2013. 2. The applicant states she completed 4 years and 6 months of USAR service with a USAR hospital unit. It was her intent to continue serving as a Soldier, but she received a left knee replacement in February 2013 and her right knee is soon to be replaced. She receives service-connected disability compensation from the Department of Veterans Affairs (VA). 3. The applicant provides her VA rating decision. CONSIDERATION OF EVIDENCE: 1. The applicant was appointed as a Reserve commissioned officer, Army Nurse Corps, and executed an oath of office on 2 January 2009. She was promoted to first lieutenant on 3 June 2010. 2. In June 2013, the Command Surgeon, 88th Regional Support Command, Fort McCoy, WI, reviewed the applicant's records and determined she was medically disqualified for retention in the U.S. Army Reserve. 3. On 3 July 2013, after having been advised of her rights, she elected to be discharged. 4. On 23 July 2013, Headquarters, 88th Regional Support Command notified the applicant that she would be separated from the U.S. Army Reserve after having been found medically disqualified for retention and election of discharged. 5. On 25 July 2013, the USAR Command, Fort Bragg, NC, published orders honorably discharging her from the U.S. Army Reserve effective 22 August 2013. 6. Aside from annual training, there is no evidence that she completed any active duty service of a duration of 90 days or more. 7. She provides her VA rating decision. REFERENCES: Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The DD Form 214 is a summary of a Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge, and is not intended to have any legal effect on termination of a Soldier's service. A DD Form 214 will be prepared for each Soldier as indicated: a. Active Army Soldiers on termination of active duty by reason of administrative separation (including separation by reason of retirement or expiration of term of service), physical disability separation, or punitive discharge under the Uniform Code of Military Justice; b. Reserve Component (RC) Soldiers completing 90 days or more of continuous active duty for training (ADT), Full-Time National Guard Duty, active duty for special work, temporary tours of active duty, or Active Guard Reserve service. Also, RC Soldiers separated for cause or physical disability, regardless of the length of time served on active duty; c. Army National Guard (ARNG) and USAR Soldiers mobilized under Title 10, U.S. Code, sections 12301(a), 12302, or 12304, and ARNG Soldiers called into Federal service under Title 10, U.S. Code, chapter 15 or section 12406, regardless of length of mobilization, when transitioned from active duty. A Soldier who reports to a mobilization station and is found unqualified for active duty will be excluded from this provision; and d. RC Soldiers completing initial ADT that results in the award of a military occupational specialty, even when the active duty period was less than 90 days. This includes completion of advanced individual training under the ARNG of the United States Alternate Training Program or the USAR Split Training Program. DISCUSSION: The available records show the applicant served in the U.S. Army Reserve from 2 January 2009 to 22 August 2013. The DD Form 214 is a summary of a Soldier's most recent period of continuous active service.
