THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Valorous Unit Award. 2. The applicant states he served with the 116th Aviation Company from October 1967 to 6 August 1968. The unit was then known as the 116th Assault Helicopter Company. DA Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register), dated 29 January 1988, shows this unit was awarded the Valorous Unit Award for the period 13 June to 23 September 1968. 3. The applicant provides a DA Form 67-6 (Officer Efficiency Report (OER)). CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of the cases and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations. 2. The applicant was appointed in the Regular Army as a first lieutenant on 13 March 1964, with prior Army National Guard commissioned service. He held several aviation officer specialties. 3. He served in Vietnam from: * 9 June 1964 to 8 June 1965, during one campaign; he was assigned to the 2nd Signal Detachment (Avionics Maintenance) * 7 August 1967 to 3 August 1968, during four campaigns; he was assigned to: * 242nd Aviation Company from 29 August to 30 September 1967 * 283rd Signal Detachment from 1 October to 26 November 1967 * 116th Aviation Company (AKA Assault Helicopter Company) from 27 November 1967 to 3 August 1968 4. He provided an OER for the rating period from 13 April to 6 July 1968 for his duties as a Field Operations Officer with the 116th Assault Helicopter Company, 269th Combat Aviation Battalion, in Vietnam. 5. He retired on 31 January 1985 for length of service. His DD Form 214 does not list the Valorous Unit Award. REFERENCES: DA Pamphlet 672-3 shows the 116th Aviation Company was cited for award of the Valorous Unit Award for the period 13 June to 23 September 1968 by DA General Orders Number 52, dated 1974. DISCUSSION: The applicant was assigned to the 116th Assault Helicopter Company, 269th Combat Aviation Battalion, Vietnam, from 13 April to 6 July 1968. GO awarded this unit the Valorous Unit Award for a period during which he was assigned to the unit.
