Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his service in Grenada. 2. The applicant states he was assigned to the 1st Battalion, 508th Infantry, and served in Grenada from 27 October 1985 to 11 November 1985. He needs help to update his DD Form 214 so he may obtain better employment. 3. The applicant provides his DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 1 February 1983 and he held military occupational specialty 76Y (Unit Supply Specialist). He also completed the Basic Airborne Course. 3. Following completion of airborne training, he was reassigned to Headquarters and Headquarters Company (HHC), 1st Battalion, 50th Infantry, on or about 14 July 1987, and then HHC, 4th Psychological Operations Group, on or about 28 September 1984, both at Fort Bragg, NC. 4. Permanent Orders 215-39, issued by Headquarters, 82nd Airborne Division, on 9 December 1983 awarded the applicant the Army Commendation Medal for meritorious achievement from 25 October 1983 to 11 November 1983 for the Grenada Operation. 5. On 11 February 1985, his immediate commander notified him of his intent to initiate separation action against him for misconduct. He advised the applicant of his rights. The applicant acknowledged receipt of the notification. 6. On 14 March 1985, his commander initiated separation action against him. The intermediate and senior commanders recommended approval. 7. On 5 April 1985, the separation authority approved the separation action and ordered the applicant discharged with an under honorable conditions (general) characterization of service. 8. The applicant was discharged on 6 May 1985. His DD Form 214 shows he completed 2 years, 3 months, and 6 days of active service. It also shows in: * Item 12f (Foreign Service), 00-00-00 * Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized), the Army Service Ribbon, Parachutist Badge, Sharpshooter Marksmanship Qualification Badge with Rifle Bar, Expert Marksmanship Qualification Badge with Grenade Bar, Army Commendation Medal, and Armed Forces Expeditionary Medal * Item 18 (Remarks), no entry pertaining to service in a hostile fire/imminent danger pay area REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) states the Armed Forces Expeditionary Medal may be awarded to members of the Armed Forces of the United States for three categories of operations: U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations. Table 2-2 provides that the Armed Forces Expeditionary Medal is authorized for designated "U.S. military operations" in Grenada (Operation Urgent Fury) from 23 October 1983 to 21 November 1983 (the qualifying criteria for non-direct support personnel in Grenada is 6 consecutive days or nonconsecutive days). 2. Army Regulation 635-5 (Personnel Separations - Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service. It establishes standardized policy for the preparation of the DD Form 214. It states for: * item 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214 * item 13, list all awards and decorations * item 18, for an active duty Soldier deployed to a foreign country with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)" DISCUSSION: The applicant served in Grenada during Operation Urgent Fury as confirmed by his award of the Army Commendation Medal and the Armed Forces Expeditionary Medal. His dates of service in Grenada from 25 October 1983 to 11 November 1983 (17 days) are consistent with the dates he claims in his application.
