THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) by adding the Defense Meritorious Service Medal, and his completion of the Command and General Staff Officer Course (CGSC) and the U.S. Marine Corps (USMC) Command and Staff College Nonresident Course. 2. The applicant states, in effect, he received the Defense Meritorious Service Medal at his retirement ceremony and it is not included on his DD Form 214. He also states his attendance at the above-cited military courses was never added. 3. The applicant provides: * DD Form 214, ending 31 March 1992 * Permanent (PO) Number 77-3, dated 26 December 1991 * Defense Meritorious Service Medal Citation * Defense Meritorious Service Medal Certificate * DA Form 1059 (Service School Academic Evaluation Report), for the period 2 May 1984 through 26 February 1986 * diploma, CGSC, dated 26 February 1986 * diploma, USMC Command and Staff College Nonresident Program, dated 9 June 1986 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. Having had prior enlisted service in the U.S. Army Reserve (USAR), he was appointed as a commissioned officer in the USAR and executed his oath of office on 18 May 1969. 3. Letter Orders Number A-02-80579, dated 18 February 1972, issued by Office of The Adjutant General, U.S. Army Reserve Components Personnel and Administration Center, ordered the applicant to active duty effective 15 March 1972 to fulfill two years of obligated service. 4. He was appointed as a Regular Army Officer and executed his oath of office on 11 August 1977. 5. His Officer Record Brief (ORB), dated November 1991, shows, in 1986, he completed both CGSC and the "MAR/CMD&STF COL NONRES" (USMC Command and Staff College Nonresident Program). 6. He was honorably retired on 31 March 1992. His DD Form 214 shows he completed 20 years and 16 days of net active creditable service. a. The applicant provides: a. PO Number 77-3, dated 26 December 14991, issued by Headquarters, Military Traffic Management Command, awarded him the Defense Meritorious Service Medal for the period 1 November 1987 to 26 January 1992. b. DA Form 1059, for the academic period 2 May 1984 through 26 February 1986, showing the applicant completed CGSC. c. Diploma, dated 9 June 1986, issued by the USMC, The Marine Corps Institute, reflecting he completed the Command and Staff College Nonresident Program. REFERENCES: AR 635-5 (Separation Documents), in effect at the time, prescribed policies and procedures for the completion of the DD Form 214. a. Item 13 will reflect awards and decorations for all periods of service. b. Item 14 will list all formal in-service (full-time attendance) training courses successfully completed during the period of the report. Command and General Staff and Senior Service Colleges may be included when successfully completed by correspondence. DISCUSSION: PO awarded him the Defense Meritorious Service Medal. This award is not listed on his DD Form 214 for the period ending 31 March 1992. Additionally, he provides proof, also confirmed by his ORB, that he completed CGSC and the USMC Command and Staff College Nonresident Program.
