Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the last two digits of his social security number (SSN) as XX23 instead of XX32. 2. The applicant states his DD Form 214 contains an incorrect SSN. In the early 1970’s he received disability benefits but the benefits were stopped for some reason. He thinks it is because his SSN is incorrect on his DD Form 214. Also in 1977, he legally changed his name and he thinks his name change may have caused confusion and loss of benefits. (Applicant does not state what benefits were stopped.) 3. The applicant provides: * DD Form 214 * social security card * court order name change * birth certificate CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's records show he entered active duty on 30 November 1963. His record contains a DD Form 398 (Statement of Personal History) that he completed during his induction processing. He indicated his SSN as XX23. 3. His record also contains a DD Form 1584 (National Agency Check Request), dated 28 June 1967, that shows the same SSN as shown on his DD Form 398. 4. On 16 February 1968 he was honorably released from active duty. The DD Form 214 he was issued at the time shows the last two digits of his SSN as XX32. 5. He provides a copy of his social security card showing the last two digits of his as XX23. 6. The applicant provides an undated and unsigned probate court document wherein he requested a name change. (The applicant did not request a correction to his military record to show a name change.) REFERENCES: Army Regulation 635-5 (Personnel Separations – Separation Documents), in effect at the time, prescribed policies and procedures for the completion of the DD Form 214. Source documents used to complete the DD Form 214 included entrance documents such as the DD Form 398. This regulation essentially states item 3 will show the SSN, as listed in source documents. DISCUSSION: The applicant's record contains a DD Form 398 and DD Form 1584 showing the last two digits of his SSN as XX23 and as shown on his social security card.
