2.  The Board determined the evidence presented is sufficient to warrant amendment of the decision of the Army Board for Correction of Military Records set forth in Docket Number AR20130008586, dated 5 December 2013, to show he is granted full relief and payment of his student loans, to include eligible loans acquired during the contract period, up to the authorized cap of $50,000.

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

CONSIDERATION OF ADDITIONAL EVIDENCE:

7.  On 29 September 2015, new information was received from the applicant regarding the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20130008586, dated 5 December 2013.

8.  The applicant submitted a new application, on 29 September 2015, because, although the Board's directive stated the ARNG should pay for any eligible student loans, those accrued during his term of enlistment in the Texas Army National Guard (TXARNG) were inadvertently excluded.

ADDITIONAL DISCUSSION:

7.  At the time of the decision of the ABCMR in Docket Number AR20130008586 on 5 December 2013, it was the intent of the ABCMR to make the applicant's record as administratively correct as it should properly have been at the time.

8.  The ABCMR's decision in Docket Number AR20130008586 inadvertently omitted those eligible student loans the applicant accumulated during his service in the TXARNG.  The advisory opinion issued by the Army Deputy Chief of Staff, G-1 clearly intended all of his eligible student loans to be included.  Additionally, on 8 August 2014, the TXARNG concurred with the ABCMR's decision.  The evidence supports a recommendation to correct his record to show he is granted full relief and payment of his student loans, to include loans acquired during the contract period, up to the authorized cap of $50,000.
