THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of Permanent Orders 181-04 and an Army Good Conduct Medal Certificate, issued by the Army Review Boards Agency, on 30 June 2015, to show: * his grade as specialist (SPC) vice private first class (PFC) * his unit as Company E, 1st Battalion, 18th Infantry, vice Company E, 1st Battalion, 120th Infantry 2. The applicant states the Board granted him relief and awarded him the Army Good Conduct Medal (1st Award) for the period 1 July 1990 through 30 June 1993. However, his last duty station was with Company E, 1st Battalion, 18th Infantry, Forces Command (FORSCOM), not Company E, 1st Battalion, 120th Infantry, Shallotte, NC 3. The applicant provides: * DD Form 214 (Certificate of Release or Discharge from Active Duty) * Permanent Orders 181-04 * Army Good Conduct Medal Certificate CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the North Carolina Army National Guard (NCARNG) on 3 October 1988 and he held military occupational specialty (MOS) 11H (Fighting Vehicle Anti-Armor Weapons Crewman). 2. He was promoted to PFC/E-3 in the ARNG on 23 April 1989. 3. He was honorably separated from the NCARNG on 15 July 1990. His NGB Form 22 (Report of Separation and Record of Service) listed his rank/grade as PFC/E-3 and his unit/station/installation as Company E, 1st Battalion (Mechanized), 120th Infantry, Shallotte, NC. 4. He enlisted in the Regular Army on 16 July 1990 and he held MOS 11H. He was assigned to Company E, 1st Battalion, 18th Infantry, Fort Benning, GA. He served in Southwest Asia from 3 September 1990 to 29 March 1991. 5. On 15 July 1991, a DA Form 4187 (Personnel Action) was prepared by the 1st Battalion, 18th Infantry, promoting him to SPC/E-4 effective 1 August 1991. 6. He was honorably discharged from active duty by reason of disability with entitlement to severance pay on 1 July 1993. His DD Form 214 shows in: * items 4a (Grade, Rate or Rank) and 4b (Pay Grade), SPC and E-4 respectively * item 12h (Effective Date of Pay Grade), 1 August 1991 7. On 23 June 2015, the Board granted him relief with regard to his request to add the Combat Infantryman Badge and Kuwait Liberation Medal. Additionally, the Board determined he was eligible for award of the Army Good Conduct Medal. As a result, the Army Review Boards Agency issued him: a. Permanent Orders 181-04 on 30 June 2015 awarding him the Army Good Conduct Medal for service during the period 1 July 190 to 30 June 1993. The orders listed his rank as "PFC" and his unit as "Company E, 1st/120th Infantry, Shallotte, NC." b. An Army Good Conduct Medal certificate that listed his name and rank of PFC. REFERENCES: Army Regulation 600-8-22 (Military Awards) states: a. The Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified. b. The DA Form 4950 (Good Conduct Medal Certificate) may be presented to enlisted Soldiers only concurrent with the first award of the Army Good Conduct Medal earned on or after 1 January 1981 or concurrent with retirement on or after 1 January 1981. When presented at retirement, the DA Form 4950 will reflect the last approved award of the Army Good Conduct Medal earned by the Soldier before retirement. DISCUSSION: The applicant was advanced to SPC/E-4 in August 1991. Upon application to this Board, he was awarded the Army Good Conduct Medal and issued a certificate. The certificate listed his rank as PFC instead of SPC and the permanent orders listed an incorrect rank and an incorrect unit.
