Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 28 February 1991 to show all authorized awards for participation in Operations Desert Shield/Desert Storm. 2. The applicant states: a. Prior to and during Operations Desert Shield/Desert Storm, he was assigned to the 1st Armored Division located in Germany. In September 1989, he was assigned to the 1st Armored Division G-4 staff. He remained in the division rear along with approximately 3,500 Soldiers, performing an assortment of functions to include security details. b. His primary functions included ensuring logistical support for the forward elements of the 1st Armored Division were met, as well as ensuring the supply line did not falter. This included, but was not limited to, ensuring that logistical items for combat helicopters were in Southwest Asia prior to unit personnel's arrival and ensuring that numerous other items were on hand to be issued and shipped out of U.S. Army Europe depots to support the 1st Armored Division elements stationed in Southwest Asia in support of the impending conflict. c. Prior to his retirement in February 1991, he was awarded the Army Commendation Medal for his actions to complete the missions. 3. The applicant provides: * DD Form 214 * Army Commendation Medal Certificate CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. Having prior enlisted service in the Regular Army, the applicant enlisted in the Regular Army on 9 August 1971. 3. His DA Form 2-1 (Personnel Qualification Record – Part II) shows he was assigned to Headquarters and Headquarters Company, 1st Armored Division (Augmentation), in Germany as the senior supply sergeant from 27 January 1989 through 19 February 1991. He departed Germany en route to the United States on 20 February 1991. 4. He retired in the rank of first sergeant on 28 February 1991. 5. Item 13 (Decorations, Medals, Citations, and Campaign Ribbons Awarded or Authorized) of his DD Form 214 for the period ending 28 February 1991 shows he was awarded or authorized the: * Army Commendation Medal (4th Oak Leaf Cluster) * Army Achievement Medal * Army Good Conduct Medal (7th Award) * National Defense Service Medal * Noncommissioned Officer Professional Development Ribbon with Numeral 3 * Army Service Ribbon * Overseas Service Ribbon (4th Award) * Driver and Mechanic Badge 6. Item 18 (Remarks) of this DD Form 214 does not show any deployments. REFERENCES: Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Southwest Asia Service Medal is awarded to all service members of the Armed Forces of the United States serving in Southwest Asia and contiguous waters or airspace there over on or after 2 August 1990 to 30 November 1995. Southwest Asia and contiguous waters as used herein is defined as the Persian Gulf; Red Sea; Gulf of Oman; Gulf of Aden; that portion of the Arabian Sea that lies north of 10 degrees north latitude and west of 68 degrees east longitude; as well as the total land areas of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar, and the United Arab Emirates. Service members of the Armed Forces of the United States serving in Israel, Egypt, Turkey, Syria, and Jordan (including the airspace and territorial waters) between 17 January 1991 and 30 November 1995 will also be eligible for this award. Service members serving in these countries must have been under the command and control of the U.S. Central Command or directly supporting military operations in the combat theater. A bronze service star is authorized for wear with this medal for participation in each credited campaign. Approved designated campaigns are: * Defense of Saudi Arabia (2 August 1990 to 16 January 1991) * Liberation and Defense of Kuwait (17 January 1991 to 11 April 1991) * Southwest Asia Cease-Fire (12 April 1991 to 30 November 1995) b. The Kuwait Liberation Medal-Saudi Arabia is awarded by the Kingdom of Saudi Arabia to service members of the Armed Forces of the United States who participated in Operation Desert Storm between 17 January 1991 and 28 February 1991 in one or more of the following areas: Persian Gulf; Red Sea; Gulf of Oman; that portion of the Arabian Sea that lies north of 10 degrees north latitude and west of 68 degrees east longitude; Gulf of Aden; or the total land areas of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar, and the United Arab Emirates. c. The Kuwait Liberation Medal-Kuwait is awarded by the State of Kuwait to service members of the Armed Forces of the United States who participated in the Operations Desert Shield and Desert Storm between 2 August 1990 and 31 August 1993 in one or more of the following areas: Arabian Gulf; Red Sea; Gulf of Oman; that portion of the Arabian Sea that lies north of 10 degrees north latitude and west of 68 degrees east longitude; Gulf of Aden; or the total land areas of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar, and the United Arab Emirates. DISCUSSION: 1. By the applicant's own admission, he was assigned to the 1st Armored Division (Rear) in Germany prior to and during Operations Desert Shield/Desert Storm and he remained in the division rear, performing an assortment of functions in support of these operations. 2. The Southwest Asia Service Medal, Kuwait Liberation Medal-Saudi Arabia, and Kuwait Liberation Medal-Kuwait eligibility criteria require service in one or more of the following areas: Persian Gulf; Red Sea; Gulf of Oman; that portion of the Arabian Sea that lies north of 10 degrees north latitude and west of 68 degrees east longitude; Gulf of Aden; or the total land areas of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar, and the United Arab Emirates. 3.
