THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) by changing the first three numbers of his social security number (SSN) in item 3 (SSN) from "395" to "396." 2. The applicant states, in effect, his SSN on his DD Form 214 is wrong; the Department of Veterans Affairs (VA) brought the error to his attention. 3. The applicant provides a copy of his DD Form 214 and his social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 20 September 1972. His DD Form 47 (Record of Induction), dated 11 September 1972, lists his SSN as starting with "396." 3. His available service record contains a U.S. Army Recruiting Command Form 180-R (Acknowledgement of Service Obligation), dated 20 September 1972, that shows the first three numbers of his SSN as "396." 4. He was honorably discharged on 16 August 1973 due to hardship. His DD Form 214 shows he completed 10 months and 27 days. Item 3 indicates the first three numbers of his SSN are "395." 5. The applicant provides a copy of his SSN card that shows the first three numbers as "396." REFERENCES: Army Regulation 635-5 (Personnel Separations - Separation Documents), in effect at the time, prescribed policies and procedures for the completion of the DD Form 214. Source documents include the DA Form 20 as well as orders. This regulation essentially states item 3 will show the SSN, as listed in source documents. DISCUSSION: The evidence indicates the SSN listed on his DD Form 47 that reflects the first three numbers as "396" is his correct SSN.
