Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal of an enlisted record brief (ERB) dated 9 October 2009 from his official military personnel file (OMPF). 2. The applicant states, in effect, the abovementioned ERB needs to be removed because it is not current and will reflect negatively when viewed by future promotion boards and for other administrative actions that require updated and current records. 3. The applicant provides the aforementioned ERB. CONSIDERATION OF EVIDENCE: 1. The applicant's records show, after prior service in the Regular Army, he enlisted in the South Dakota Army National Guard (SDARNG). He was honorably discharged from the SDARNG on 28 May 2002. 2. On 29 May 2002, he enlisted in the Regular Army. He has served continuously on active duty in a variety of positions and is currently a sergeant first class who is deployed in Kuwait. 3. A review of the service folder of his OMPF reveals an ERB dated 9 October 2009. 4. Army Regulation 600-8-104 (Army Military Human Resource Records (AMHRR) Management) prescribes policies and procedures for the creation, utilization, administration, maintenance, and disposition of personnel records to include the OMPF. Appendix B (Documents Required for Filing in the OMPF and Interactive Personnel Electronic Records Management System (iPERMS)), Table B-1, provides a list of required documents for filing in the OMPF. With regard to the ERB, it essentially requires only the last ERB produced before separation or a change in Component to be filed. When this occurs it is placed in the service folder. DISCUSSION AND CONCLUSIONS: The applicant requests removal of an ERB dated 9 October 2009 from the service folder within his OMPF. The regulation only requires an ERB to be filed when the Soldier is separating or changing component. The applicant is currently on active duty and last changed components in 2002. It would thus be appropriate to remove this ERB as its current placement does not meet the regulation's criteria for being filed.
