THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 2 (Service Number) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his service number as US XX XX8 XXX instead of US XX XX9 XXX. 2. The applicant states the service number on his DD Form 214 is incorrect. 3. The applicant provides: * letter of commendation, dated 30 October 1967 * appointment orders, dated 20 September 1968 * DA Form 2139-1 (Military Pay Voucher) for pay period 1-30 November 1968 * Army Commendation Medal Certificate, dated 16 April 1969 * reassignment orders, dated 18 April 1969 * DD Form 214 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 22 September 1967. 3. He provided the following documents showing his service number as US XX XX8 XXX: * letter of commendation, dated 30 October 1967 * appointment orders, dated 20 September 1968 * DA Form 2139-1 for pay period 1-30 November 1968 * Army Commendation Medal Certificate, dated 16 April 1969 * reassignment orders, dated 18 April 1969 4. On 12 May 1969, he was honorably released from active duty. Item 2 of his DD Form 214 shows his service number as US XX XX9 XXX. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It established standardized policy for preparing and distributing the DD Form 214. The instructions for item 2 stated to enter the individual's service number and authorized prefix. DISCUSSION: The applicant's DA Form 2139-1 shows he recorded his service number as US XX XX8 XXX in November 1968. However, his DD Form 214 shows his service number as US XX XX9 XXX.
