Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her narrative reason for separation. 2. The applicant states she does not have a personality disorder and never did. When presenting her military discharge to others, her character is slandered because of this error. 3. The applicant provides no additional evidence. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 7 October 2003 for a period of 4 years. 3. She deployed to Iraq on 17 January 2005. 4. On 3 October 2005, she received a letter of reprimand for abandoning her guard post on 15 July 2005. 5. On 18 October 2005, she underwent a mental status evaluation. The evaluating psychiatrist diagnosed her with a personality disorder (not otherwise specified). The psychiatrist determined she had a pattern of thought and behavior that was longstanding in nature and was unlikely to change with any effort by the command to rehabilitate her. Medical/mental health treatments were also unlikely to result in significant change. She had no condition which warranted disposition through the physical disability evaluation system. [She had no physical profile.] She met the criteria for personality disorder and was cleared for administrative separation if deemed appropriate by her command. 6. On 14 November 2005, she was notified of her pending separation for personality disorder under the provisions of Army Regulation 635-200 (Active Duty Enlisted Administrative Separations), paragraph 5-13 (Separation because of personality disorder). Her commander recommended characterization of her service as honorable and cited the following reasons for the proposed action: a. On 21 October 2005, she destroyed her living quarters (resulting in approximately $1,000.00 in damages) and she cut off her hair. b. While being transported to the mental health clinic by military police, she jumped out of a moving vehicle. c. The military psychiatrist stated she met the criteria for personality disorder and that medical/mental health treatments were unlikely to result in significant changes. 7. On 14 November 2005, she acknowledged notification of her pending separation, was advised of her rights, waived counsel, and declined to make a statement in her own behalf. 8. She departed Iraq on 23 December 2005. 9. The separation authority approved the applicant's separation under the provisions of Army Regulation 635-200, paragraph 5-13, by reason of personality disorder and directed characterization of her service as honorable. 10. On 2 February 2006, she was discharged accordingly. Her DD Form 214 (Certificate of Release or Discharge from Active Duty) shows in: * item 25 (Separation Authority) – Army Regulation 635-200, Paragraph  5-13 * item 26 (Separation Code) – JFX * item 28 (Narrative Reason for Separation) – Personality Disorder REFERENCES: 1. Army Regulation 635-200 prescribes the policy for the administrative separation of enlisted personnel. Paragraph 5-13 provides for separating members by reason of personality disorder (not amounting to disability) that interferes with assignment or with performance of duty. 2. Army Regulation 635-5-1 (Separation Program Designator (SPD) Codes), in effect at the time, provided the specific authorities (regulatory or directive), reasons for separating Soldiers from active duty, and the SPD codes to be entered on the DD Form 214. It stated that SPD code JFX was the appropriate code to assign to Soldiers being separated under the provisions of Army Regulation 635-200, paragraph 5-13, by reason of personality disorder. DISCUSSION: 1. The evidence of record does not support the applicant's contention that she does not have a personality disorder and never did. On 18 October 2005, she was diagnosed as having a personality disorder by a military psychiatrist. 2.
