Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show her foreign service in Korea. 2. The applicant states she served in Wonju, Korea, from January 2001 to December 2001 and her DD Form 214 should reflect this period of foreign service. 3. The applicant provides a copy of her DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 1 August 2000 for a period of 4 years. 3. Defense Finance and Accounting Service records show she received overseas pay for service in Korea from 4 January 2001 to 17 December 2001, a period of 11 months and 14 days. 4. Her records show she served in Iraq from 14 February 2004 to 3 March 2005, a period of 1 year and 20 days. 5. On 31 May 2005, she was honorably released from active duty. 6. Her DD Form 214 shows she was awarded or authorized the: * Army Lapel Button * Global War on Terrorism Expeditionary Medal * Global War on Terrorism Service Medal * National Defense Service Medal * Army Service Ribbon 7. Item 12f (Foreign Service) of her DD Form 214 shows she completed 1 year, 3 months, and 21 days of foreign service. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) states the Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who served on active duty in support of the defense of the Republic of Korea. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. The instructions for item 12f stated to enter the total amount of foreign service completed during the period covered by the DD Form 214 from the Soldier's record. DISCUSSION: 1. The applicant's request for correction of her DD Form 214 to show her foreign service in Korea has merit. The evidence of record shows she completed 11 months and 14 days of foreign service in Korea and she completed 1 year and 20 days of foreign service in Iraq, a total of 2 years and 4 days. Item 12f of her DD Form 214 does not show she completed 2 years and 4 days of foreign service. 2. As a related issue, she served a qualifying period for award of the Korea Defense Service Medal.
