Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Afghanistan Campaign Medal and to show his period of service in Afghanistan. 2. He states that he served in Afghanistan during Operation Enduring Freedom from 1 March to 19 October 2013. 3. He provides his DD Form 214, military orders, and performance evaluations. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 12 May 2009. He was released from active duty on 26 January 2015. His DD Form 214 shows he was awarded or authorized: * Iraq Campaign Medal with two campaign stars * Army Commendation Medal (2nd Award) * Army Achievement Medal * Army Good Conduct Medal * National Defense Service Medal * Global War on Terrorism Service Medal * Army Service Ribbon * Overseas Service Ribbon * North Atlantic Treaty Organization Medal * Combat Infantryman Badge 3. His DD Form 214 does not list service in Afghanistan in item 18 (Remarks). 4. Defense and Finance Accounting Service (DFAS) records confirm the applicant received hostile fire (HF)/imminent danger pay (IDP) for service in Afghanistan from 28 February to 3 November 2013. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) states the Afghanistan Campaign Medal is awarded to members who have served in direct support of Operation Enduring Freedom (OEF). The area of eligibility encompasses all the land area of the country of Afghanistan and all air spaces above the land area. The period of eligibility is on or after 11 September 2001 to 31 December 2014. A bronze service star is authorized for wear with this medal for participation in each credited campaign. A review of the applicant's records shows he participated in one campaign (Transition I - 1 July 2011 to 31 December 2014) during his service in Afghanistan. 2. Army Regulation 635-5 (Separation Processing and Documents), as then in effect, provided detailed instructions for completing separation documents, including the DD Form 214.  It provided that Item 18 (Remarks) would contain the following entry for Regular Army Soldiers: "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates)." DISCUSSION: DFAS records confirmed the applicant received HF/IDP for service in Afghanistan from 28 February to 3 November 2013. This is a qualifying period of service for award of the Afghanistan Campaign Medal. Further, he participated in one campaign authorizing him a bronze service star for wear on this medal.
