Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as "XXX-XX-XXX9" instead of "XXX-XX-XXX1." 2. The applicant states that at the time of his discharge, he did not look that closely at his DD Form 214. He is currently looking into the benefits available to him and came across the mistake. 3. The applicant provides: * DD Form 214 * driver's license * social security card * National Guard Bureau (NGB) Form 55b (Honorable Discharge Certificate) * DA Form 977 (Retired Reserve Certificate) CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Army National Guard (ARNG) of the State of Pennsylvania on 3 February 1966. 3. He entered active duty for training on 31 July 1966. On 3 December 1966, he was honorably released from training and returned to the control of the ARNG of the State of Pennsylvania. Item 32 (Remarks) of the DD Form 214 he was issued lists his SSN as "XXX-XX-XXX1." 4. On 2 February 1973, he was honorably discharged from the ARNG of the State of Pennsylvania. His record contains an NGB Form 22 (Report of Separation and Record of Service) which lists his SSN as "XXX-XX-XXX9." 5. He provided his social security card, a DA Form 977, and an NGB Form 55b, which list his SSN as "XXX-XX-XXX9." REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time of the applicant's separation, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. This regulation established standardized policy for the preparation of the DD Form 214. It stated, in pertinent part, that the complete name and SSN of the separating service member would be entered on the DD Form 214. DISCUSSION: The applicant's SSN appears as "XXX-XX-XXX9" on his NGB Form 22 and social security card; however, it appears as "XXX-XX-XXX1" on his DD Form 214.
