Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show all authorized awards for his military service from August 1976 to August 1980 and issuance of the medals he earned. 2. The applicant states he never received his medals for his military service from August 1976 to August 1980. He doesn't believe he received all of the medals awarded to him during his service in the Army. 3. The applicant provides no additional evidence. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 5 August 1976 for a period of 4 years. He served as a fire support specialist while assigned to Headquarters and Headquarters Battery, 1st Battalion, 10th Field Artillery Regiment, 3d Infantry Division, in Germany from 8 December 1976 through 25 November 1978. 3. Item 9 (Awards, Decorations, and Campaigns) of his DA Form 2-1 (Personnel Qualification Record – Part II) shows he was awarded or authorized the: * Army Commendation Medal * Army Good Conduct Medal (1st Award) * Expert Marksmanship Qualification Badge with Rifle Bar (M-16) * Sharpshooter Marksmanship Qualification Badge with Grenade Bar 4. On 4 August 1980, he was honorably released from active duty. He completed 4 years of active service during this period. 5. His DD Form 214 shows he was awarded or authorized the: * Army Commendation Medal * Army Good Conduct Medal * Expert Marksmanship Qualification Badge with Rifle Bar (M-16) * Sharpshooter Marksmanship Qualification Badge with Grenade Bar 6. There is no evidence showing he was authorized any other awards or decorations under the provisions of Army Regulation 600-8-22 (Military Awards). REFERENCES: Army Regulation 600-8-22 prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. DISCUSSION: 1. There is no evidence showing he was authorized any other awards or decorations under the provisions of Army Regulation 600-8-22. 2. The ABCMR does not reissue medals. Requests for medals should be forwarded to the National Personnel Records Center.
