The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: * awarding him the Army Good Conduct Medal (2nd Award) for service from 19 August 2012 through 18 August 2015 * deleting from his DD Form 214 the Army Good Conduct Medal * adding to his DD Form 214 the Army Good Conduct Medal (2nd Award) and Army Achievement Medal 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests award of the Combat Action Badge and a second award of the Army Good Conduct Medal. 2. The applicant states he took incoming 122 mm rounds at Camp Taji in May 2011; he was 300 meters away. Fifty-six rockets were fired, 12 of which were 400 meters away from the airfield. Additionally, he received his first award of the Army Good Conduct Medal, but he completed 6 years of active service with no adverse action. 3. The applicant provides his DD Form 214 (Certificate of Release or Discharge from Active Duty). CONSIDERATION OF EVIDENCE: 1. With respect to the Combat Action Badge, the applicant's request is premature. a. Paragraph 2-5 of Army Regulation 15-185 (Army Board for Correction of Military Records), the regulation under which this Board operates, states the Board will not consider any application if it determines that the applicant has not exhausted all available administrative remedies. There is no evidence that the applicant submitted an application for award of the Combat Action Badge to the Commander, U.S. Army Human Resources Command, ATTN: Veterans Services, 1600 Spearhead Division Avenue, Fort Knox, KY  40121-5743, and was denied this award. b. The Combat Action Badge may be requested by letter with the following supporting documents: * assignment, attachment, or operational control orders * a copy of the Soldier's Officer or Enlisted Record Brief * a copy of the chain of command endorsement * a one-page narrative description of the qualifying incident * a certified copy of the DD Form 214 * any other supporting documentation c. The request for the Combat Action Badge will not be further discussed in this Record of Proceedings. 2. The applicant enlisted in the Regular Army on 18 August 2009 and he held military occupational specialty (MOS) 12B (Combat Engineer). He served in Iraq from 8 November 2010 to 11 November 2011. 3. He was honorably released from active duty in the rank/grade of specialist (SPC)/E-4 on 10 October 2015, and he was fully eligible to reenlist. His DD Form 214 shows he completed 6 years, 1 month, and 11 days of active service. It also shows he was awarded or authorized the: * Army Commendation Medal * Meritorious Unit Commendation * Army Good Conduct Medal * Global War on Terrorism Expeditionary Medal * Global War on Terrorism Service Medal * Iraq Campaign Medal with campaign star * Army Service Ribbon * Overseas Service Ribbon 4. His records do not contain any orders awarding him the Army Good Conduct Medal. Additionally, his records does not contain an adverse information or a disqualification memorandum, disqualifying him from receiving his second award of the Army Good Conduct Medal. 5. Permanent Orders (PO) Number 180-01, issued by Headquarters, Engineer Battalion, 2nd Armored Brigade Combat Team, on 29 June 2015 awarded him the Army Achievement Medal for service from April 2010 to October 2015. 6. His records do not contain a recommendation or orders for award of the Combat Action Badge. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) states the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of active Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified. 2. Army Regulation 635-5 (Separation Documents) established the standardized policy for preparing and distributing the DD Form 214. Chapter 2 contained guidance on the preparation of the DD Form 214. It states for item 13, enter all awards, decorations, and badges. DISCUSSION: 1. The applicant met the criteria for a second award of the Army Good Conduct Medal and its addition to his DD Form 214. * he completed 6 years, 1 month, and 23 days of continuous active service; each award requires 3 years of continuous active service * there is no derogatory information in his record that would disqualify him from receiving this award * he served a combat tour, attained the rank/grade of SPC/E-4 and was fully eligible to reenlist upon separation 2. PO awarded him the Army Achievement Medal.
