Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the: * Army Achievement Medal (2nd Award) * North Atlantic Treaty Organization (NATO) Medal * Armed Forces Expeditionary Medal * Armed Forces Service Medal 2. The applicant states the awards are not listed on his DD Form 214. 3. The applicant provides: * DD Form 214 * NATO Medal Certificate * Operation Joint Endeavor Scroll of Appreciation * Operation Joint Guard Scroll of Appreciation * four certificates for award of the Army Achievement Medal * Table designating military operations approved for award of the Armed Forces Service Medal * statute authorizing award of the Armed Forces Expeditionary Medal CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 5 November 1991. He held military occupational specialty 63D (Field Artillery Systems Mechanic). He reenlisted on 19 April 1995. 3. He served in Korea from 13 April 1992 to 12 April 1993. He was credited with completion of an overseas tour. Following this tour, he was reassigned to Fort Hood, TX. 4. Permanent Orders (PO) Number 26-03, issued by Headquarters, 1st Battalion, 14th Field Artillery, Fort Hood, dated 22 November 1994, awarded him the Army Achievement Medal for achievement from 11 July to 1 September 1994. 5. PO Number 87-03, issued by Headquarters, 1st Battalion, 14th Field Artillery, Fort Hood, dated 1 December 1995, awarded him the Army Achievement Medal for service from 1 April 1993 to 1 January 1995. 6. He also served in Germany from 3 January 1996 to on or about 18 December 1998. He was credited with completion of an overseas tour. While in Germany: * he received a Scroll of Appreciation for deployment to the Former Republic of Yugoslavia in support of Operation Joint Endeavor with the 1st Battalion, 7th Field Artillery * he received a Scroll of Appreciation for deployment to the Former Republic of Yugoslavia in support of Operation Joint Guard with the 1st Battalion, 7th Field Artillery * he was awarded the NATO Medal for service with NATO on operations in relation to the Former Republic of Yugoslavia from 7 October 1996 to 5 April 1997 * PO Number 62-24, issued by Headquarters, 1st Battalion, 7th Field Artillery, Bosnia, on 3 March 1997, awarded him the Army Achievement Medal for service while deployed to Bosnia-Herzegovina from 22 October 1996 to 5 April 1997 in support of Operation Joint Endeavor and Joint Guard * PO Number 320-09, issued by Headquarters, 1st Battalion, 7th Field Artillery, Schweinfurt, Germany, on 16 November 1998, awarded him the Army Achievement Medal for service from 31 December 1996 to 10 January 1999 7. He was honorably released from active duty on 20 December 1998. His DD Form 214 shows in: * item 12f (Foreign Service) – he completed 3 years, 11 months, and 18 days of foreign service * item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized), he was awarded or authorized the – * Army Good Conduct Medal (2nd Award) * National Defense Service Medal * Army Service Ribbon * Overseas Service Ribbon (2nd Award) * Driver/Mechanic Badge with Driver-T Bar * item 18 (Remarks) – does not reflect his service in a hostile fire/imminent danger pay area 8. Item 9 (Awards, Decorations, and Campaigns) of his DA Form 2-1 (Personnel Qualification Record – Part II) shows he was awarded the Marksman Marksmanship Qualification Badge with Rifle Bar (M-16) and Sharpshooter Marksmanship Qualification Badge with Grenade Bar in addition to the awards listed on his DD Form 214. REFERENCES: 1. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of his or her military service. Chapter 2 contains guidance on the preparation of the DD Form 214. It states for: * item 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214 * item 13, enter all awards and decorations * item 18, for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (country deployed) FROM (inclusive dates, for example, YYYYMMDD-YYYYMMDD)" 2. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who served on active duty in support of the defense of the Republic of Korea. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense. b. The Armed Forces Expeditionary Medal for qualifying service after 1 July 1958 in U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations. Qualifying service for this award includes participation in the Former Republic of Yugoslavia for Operations Joint Endeavor and Joint Guard from 1 June 1992 to 20 June 1998 (only for participants deployed to Bosnia-Herzegovina and Croatia). 3. U.S. Army Personnel Command Message Number 99-100, dated 121605Z March 1999, authorized award of both the Armed Forces Service Medal and the Armed Forces Expeditionary Medal as a one-time exception to DOD and Service policy, for qualifying service in support of Operations Joint Endeavor and Operation Joint Guard in Bosnia-Herzegovina. This exception allowed both service medals to be presented to personnel deployed in Bosnia-Herzegovina or aboard naval vessels operating in the Adriatic Sea and their respective air spaces during the period, for the purpose of this award from 20 November 1995 to 19 December 1996 for Operation Joint Endeavor also for the purpose of this award from 20 December 1996 to 20 June 1998 for Operation Joint Guard. DISCUSSION: 1. The applicant serves in Korea qualifies him for award of the Korea Defense Service Medal. This award is not reflected on his DD Form 214. 2. The evidence of record shows the applicant was awarded four Army Achievement Medals and the NATO Medal. These awards are not reflected on his DD Form 214. 3. Based on the applicant's service during his units deployed to Bosnia-Herzegovina from 22 October 1996 to 5 April 1997 in support of Operation Joint Endeavor/Joint Guard, he meets the criteria for award of the Armed Forces Expeditionary Medal and the Armed Forces Service Medal. These awards and unit deployment are not reflected on his DD Form 214. 4. His DA Form 2-1 lists award of the Marksman Marksmanship Qualification Badge with Rifle Bar (M-16) and Sharpshooter Marksmanship Qualification Badge with Grenade Bar.
