Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show her military training time in basic training and advanced individual training (AIT). 2. The applicant states that her active basic training and AIT are not shown on her DD Form 214. Also, item 12a (Date Entered Active Duty This Period) and item 14 (Military Education) do not reflect when she entered active duty to attend basic training and AIT. Based on item 18 (Remarks) on her DD Form 214, it was already known that information was missing. She states she attended basic training from August 2004 to October 2004 and AIT from November 2004 to February 2005. Upon her discharge from Camp Shelby, the accurate data failed to be annotated on her DD Form 214, but item 18 states that a DD Form 215 (Correction to DD Form 214) will be issued to provide missing information. 3. The applicant provides: * DD Form 4 (Enlistment/Reenlistment Document – Armed Forces of the United States) * DD Form 1966 (Record of Military Processing – Armed Forces of the United States) * Statement of Understanding – the Montgomery GI Bill Selected Reserve * Selected Reserve Incentive Program – Enlistment Bonus Addendum * Statement of Understanding – the Montgomery GI Bill Selected Reserve Montgomery GI Bill Kicker Program * Certificate and Acknowledgement U.S. Army Reserve Service Requirements and Methods of Fulfillment * DD Form 369 (Police Record Check) * DD Form 214 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's DD Form 4 shows she enlisted in the U.S. Army Reserve on 8 May 2004. Her DD Form 1966 indicates in bock 18(b) that she entered active duty on 25 August 2004. Her service record does not include active duty orders assigning her to basic training or AIT. 3. She provided a Retirement Detail History that shows she received active duty points for the period 25 August 2004 through 17 February 2005 (177 points). Her service record is void of a DD Form 214 that covers this period of active duty. 4. She was ordered to active duty on 5 July 2006 in support of Operation Iraqi Freedom. 5. The Army honorably discharged her from active duty on 4 September 2006 and transferred her to the U.S. Army Reserve Control Group (Reinforcement). Her DD Form 214 shows the following information: * Item 11 (Primary Specialty), she held military occupational specialty (MOS) 92A1O (Automated Logistical) for 1 year and 6 months * Item 12a, she was ordered to active duty on 5 July 2006 * Item 12d (Total Prior Active Service), the entry "SEE BLOCK #18" * Item 12e (Total Prior Inactive Service), the entry "SEE BLOCK #18" * Item 14 (Military Education), the entry "NONE//NOTHING FOLLOWS" * Item 18 (Remarks), the entry "DD FORM 215 WILL BE ISSUED TO PROVIDE MISSING INFORMATION" and "ITEM 12D ABOVE DOES NOT ACCOUNT FOR ANNUAL TRAINING AND/OR WEEKEND TRAINING THIS SOLDIER MAY HAVE ACCOMPLISHED PRIOR TO DATE ENTERED IN ITEM 12A" REFERENCES: Army Regulation 635-5 (Separation Documents) in effect at the time governed the preparation of the DD Form 214. It is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge. A DD Form 214 will be prepared for each Soldier: a. Reserve component (RC) Soldiers completing 90 days or more of continuous active duty for training (ADT), Full-Time National Guard Duty, active duty for special work, temporary tours of active duty or Active Guard Reserve service, except as specified in subparagraphs (3) through (5) of this regulation. b. RC Soldiers completing initial ADT that results in the award of an MOS, even when the active duty period was less than 90 days. This includes completion of AIT under Army National Guard of the United States (ARNGUS) Alternate Training Program or U.S. Army Reserve Split Training Program. c. For item 12d, enter total amount of prior active service less lost time from previously issued DD Forms 214. d. For item 12e, from previously issued DD Forms 214 or Enlisted Record Briefs, enter the total amount of prior inactive service, less time lost. e. For item 14, from the Enlisted Record Brief list formal in-service training courses successfully completed during the period under review by including the title, length in weeks and year completed. This information is to assist the Soldier in job placement and counseling; therefore, do not list training courses for combat skills. f. For item 18, use this block for Headquarters, Department of the Army mandatory requirements when a separate block is not available. DISCUSSION: 1. The applicant enlisted in the U.S. Army Reserve on 8 May 2004. 2. The applicant's DD Form 1966 and Retirement Detail History show she entered active duty on 25 August 2004. 3. The applicant states she attended basic training from August 2004 to October 2004 and AIT from November 2004 to February 2005. Her Retirement Detail History reflects she received retirement points for active duty training from 25 August 2004 through 17 February 2005. Nothing in the record contradicts these dates as the period during which she underwent initial entry training. The Board must determine if this data is sufficient as a basis for amending items 12d and 12e of her 2006 DD Form 214. 4. The evidence of record shows the applicant was ordered to active duty on 5 July 2006 in support of Operation Iraqi Freedom and this date was properly entered in item 12a of her DD Form 214.
