Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his request for correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the Valorous Unit Award (VUA). 2. The applicant states the Board's decision in the original consideration of his case denied correction of his records to show the VUA that was awarded to the 11th Armored Cavalry Regiment (ACR) and its attached and supporting units for the period 31 January 1968 to 5 February 1968 for actions in the Republic of Vietnam (RVN) at Bihn Long, Bien Hoa Province. He notes that he was assigned to 3rd Platoon, C Troop, 1st Squadron, 11th ACR, from 7 January 1968 to 17 June 1968. a. He states that the Board acknowledged he was assigned to C Troop, 1st Squadron, 11th ACR, during the period in question. However, the Board also concluded that he was not assigned to a qualifying unit for the VUA and asserted that the general order (GO) that awarded the 11th ACR the VUA included the 3rd Squadron, but the squadron was later deleted from the GO. Consequently, he was not entitled to correction of his records to show the unit award. b. The applicant states it is his position that the 1st Squadron (and the 3rd Squadron) was an (were) assigned unit(s) (i.e., organic) to the 11th ACR and the amendment to delete the 3rd Squadron was to correct that administrative error. He also states that he spoke to the historian for the 11th ACR and he confirmed that the regiment and its assigned and attached units were awarded the VUA for actions during the cited period. 3. The applicant provides copies of the following documents: * Headquarters, U.S. Army Vietnam (USARV), General Orders Number 5069, dated 1 November 1968 * Center for Military History, 11th ACR (The Blackhorse Regiment), Lineage and Honors CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20150002153 on 13 October 2015. 2. The applicant was inducted into the U.S. Army on 2 August 1967. He was awarded military occupational specialty 11B (Light Weapons Infantryman). 3. A review of the applicant's military personnel records shows he: * deployed to Vietnam on 7 January 1968 * was assigned to C Troop, 1st Squadron, 11th ACR, on 11 January 1968 * was wounded in action on 10 June 1968 * was medically evacuated to the 249th General Hospital (Japan) on 4 July 1968 4. The applicant's DD Form 214 shows he entered active duty on 2 August 1967, was honorably released from active duty on 6 June 1969, and transferred to the U.S. Army Reserve Control Group (Annual Training) to complete his reserve service obligation. He had completed 1 year, 10 months, and 5 days of total active duty service this period. Headquarters, DAGO Number 45, dated 19 July 1969, awarded the Presidential Unit Citation (Army) to the 1st Squadron, 11th ACR, and 1st Platoon, 919th Engineer Company, for gallantry in action while engaged in military operations in RVN during the period 11 May 1968 to 3 June 1968. 9. In support of his request the applicant provides a Center of Military History, Lineage and Honors (Information and Decorations), pertaining to the 11th ACR (The Blackhorse Regiment) that shows, in pertinent part: * 11th ACR was awarded the VUA for Binh Long-Bien Hoa (RVN), from 31 January to 5 February 1968 in DAGO Number 28 (1968), as amended by DAGO Number 12 (1969) [sic] * 1st Squadron (with all assigned units) was awarded the Presidential Unit Citation (Army) for Hau Nghia-Binh Duong (RVN), for the period 11 May to 2 June 1968 in DAGO 45 (1969) 10. A request for review of the Awards and Decorations Computer-Assisted Retrieval System, an index of general orders issued during the Vietnam-era between 1965 and 1973 maintained by the U.S. Army Human Resources Command, Awards and Decorations Branch, failed to return any additional award orders pertaining to the applicant. REFERENCES: DA Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the awards received by units serving in Vietnam. It shows that during the applicant's period of assignment to 1st Squadron, 11th ACR – * the regiment was cited for award of the – * VUA for the period 31 January 1968 to 5 February 1968 in DAGO Number 12 (1969), as amended by DAGO Number 28 (1969) * RVN Gallantry Cross with Palm Unit Citation for the period 7 September 1966 to 10 August 1968 in DAGO Number 60 (1969) * 1st Squadron was cited for award of the Presidential Unit Citation (Army) for the period 11 May 1968 to 2 June 1968 in DAGO Number 45 (1969) DISCUSSION: 1. Records show the applicant was assigned to C Troop, 1st Squadron, 11th ACR in RVN during the period 11 January 1968 through 10 June 1968. 2. The evidence of record shows the 11th ACR and assigned, attached, and supporting units was awarded the VUA for the period 31 January 1968 to 5 February 1968. The USARV GO that announced the unit award did not list the assigned units (i.e., the organic units of the 11th ACR), it listed the attached and supporting units. However, when the unit award was promulgated in DAGO Number 12 (1969) two assigned (organic) units of the 11th ACR were listed as attached/supporting units. DAGO Number 28 (1969) corrected the administrative error and deleted the two 11th ACR assigned units. a. The Board erred in denying the applicant correction of his records to show award of the VUA for the period 31 January 1968 to 5 February 1968. b.
