Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests inclusion of his Ranger Tab on his DD Form 214 (Certificate of Release or Discharge from Active Duty). 2. The applicant states he completed Ranger School on 7 April 1983 and was awarded the additional skill identifier (ASI) "V." 3. The applicant provides copies of his Ranger Course diploma and his DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted on 24 February 1982, completed training, including basic airborne training, and was awarded the military occupational specialty 11B1P (Light Weapons Infantryman – Parachutist). 3 On 7 April 1983, he successfully completed the Ranger Course and was awarded ASI "V" and MOS 11B1V (Light Weapons Infantryman – Ranger Parachutist). He was subsequently assigned to duty in Germany. 4. The applicant was released from active duty on 19 February 1985. His DD Form 214 shows the following: * rank and pay grade of specialist four (SP4)/E-4 * MOSC 11B1V * 2 years, 11 months, and 26 days of active service with no lost time * honorable characterization of service * no military education during this period * authorized awards – * Army Service Ribbon * Overseas Service Ribbon * Parachutist Badge * Expert Marksmanship Qualification Badge with Rifle Bar (M-16) * Sharpshooter Marksmanship Qualification Badge with Hand Grenade Bar * Army Achievement Medal 5. The applicant's records contain no derogatory entries, disciplinary actions, nonjudicial punishments, or court-martial convictions that would suggest he was not eligible for award of the Army Good Conduct Medal. REFERENCES:[UAu2] Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of active Federal military service. A record of punishment is not automatically disqualifying. However, at that time, a single efficiency rating of less than "excellent" was disqualifying. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified. Current practice requires that the commander provide written notice of nonfavorable consideration and permits the individual to respond. b. The Ranger Tab is awarded for successful completion of a Ranger Course conducted by the U.S. Army Infantry School or the Ranger Training Command. DISCUSSION: 1. The applicant's award of the Ranger Tab was omitted from his DD Form 214. 2. The applicant distinguished himself by his conduct, efficiency and fidelity as evidenced by his personal awards and his advancement to pay grade E-4. His records contains no indication of any disqualifying incidents or recommendations that would preclude award of the Army Good Conduct Medal (1st Award). //NOTHING FOLLOWS// [UAu1]Should be a partial grant, because the board is granting him the Ranger Tab and not granting him the removal of the “V” identifier on his MOS in block 11 of his DD 214. [UAu2]We may want to add a reference for the ASI/SQI to address his request of removal to “V” identifier from his MOS.
