Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the social security number (SSN) listed on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show XXX-XX-XXX2 instead of XXX-XX-XXX8. 2. The applicant states, in effect, his DD Form 214 incorrectly shows his SSN as XXX-XX-XXX8. 3. The applicant provides his Medicare Health Insurance Card and DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 21 October 1966. At that time, a military service number was issued for the purpose of identification. 3. His service record contains a DD Form 398 (Statement of Personal History), DA Form 41 (Record of Emergency Data), and DA Form 137 (Installation Clearance Record) that all reflect his SSN as XXX-XX-XXX2. 4. The Army released him from active duty on 15 January 1968. His DD Form 214 shows his SSN as XXX-XX-XXX8. 5. He provided his Medicare Health Insurance Card that shows his SSN as XXX-XX-XXX2. REFERENCES: Army Regulation 635-5 (Separation Documents), dated 23 January 1967, governed the preparation of the DD Form 214. It states that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. This regulation states to transcribe the Soldier?s Social Security account number from the DA Form 2139 (Military Pay Voucher) and enter it in item 3 (SSN) of the DD Form 214. DISCUSSION: 1. The applicant entered active service on 21 October 1966. At that time, a military service number was issued for the purpose of identification. However, his DD Form 398 and DA Form 41 both show his SSN as XXX-XX-XXXX2. 2. The Medicare Health Insurance Card he provided also show his SSN as XXX-XX-XXX2. 3.
