As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) with an effective date of separation of 19 November 1965 by: a. deleting the current social security number (SSN) in item 32 (Remarks) and adding SSN X5X-XX-XXXX, as shown on his DA Form 41 (Record of Emergency Data), item 7 (SSN); and b. deleting the current entry from item 19c (Date of Entry) and adding the entry “1 December 1962,” as shown on his DA Form 4 (Enlistment Record – Armed Forces of the United States), item 8. _____________x____________ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests his social security number (SSN) be changed from X1X-XX-XXXX to X5X-XX-XXXX on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), with an effective date of 19 November 1965. 2. The applicant states, in effect, the SSN listed on his DD Form 214 is incorrect. He states the second digit is wrong. 3. The applicant provides: * DD Form 214 * Social Security Card * Driver's License CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 1 December 1962, he enlisted in the Regular Army. His DD Form 4 (Enlistment Record – Armed Forces of the United States) shows in item 2 (Service Number) X8XXXXXX. No SSN is listed on this document. 3. On 4 February 1965, the applicant signed a DA Form 41 (Record of Emergency Data) that shows in item 7 (SSN) X5X-XX-XXXX. 4. On 19 November 1965, he was discharged from active duty. Item 2 (Service Number) of his DD 214 (Armed Forces of the United States Report of Transfer or Discharge) shows X8XXXXXX, item 3 (Grade, Rate or Rank) shows SP4/E4 (P) See [Item] 32. Item 32 (Remarks) shows SSAN X1X-XX-XXXX. His DD 214 item 19c shows his enlistment date as “31 November 1962.” 5. On 22 June 1967, he signed an USAAC Form 66 (Army Reserve Personnel Data Review), item 1 (SSN) shows the information on file listed his SSN as X1X-XX-XXXX and it was being corrected or changed to show SSN X5X-XX-XXXX. 6. Item 26 (SSAN) of his Transcripts of Master Personnel Record (Enlisted), dated 9 October 1967, shows his SSN as X5X-XX-XXXX. 7. The applicant provides his social security card which shows his SSN as X5-XX-XXXX and his driver’s license, which does not list an SSN. REFERENCES: 1. Army Regulation 600-2 (Name, Service Number, and Birth Data), in effect at the time, prescribed the procedures used for recording, issuing, or changing personnel information normally used as a means of identification. a. Service numbers were assigned to men inducted into the Army of the United States under the Universal Military Training and Service Act to whom a number had not been assigned previously. b. The service number of an in individual in the military is essential for official identification since many members of the armed forces have identical names. c. The last name, first name, middle initial, and service number normally will be recorded in that order in all military records. 2. Army Regulation 635-5 (Separation Documents), then in effect, prescribed policies and procedures regarding separation documents. It also established standardized policy for preparing and distributing the DD Form 214. The purpose of a separation document is to provide the individual with evidence of his or her military service at the time of separation. It is a vital record for interested government agencies which assists the veteran in obtaining the rights and benefits to which he is entitled. It is important that information entered thereon is complete and accurate. It stated for item 3 to enter the individual's SSN. DISCUSSION: 1. The SSN on the social security card provided by the applicant was recorded in his military records. It appears his SSN was transcribed incorrectly at some point and this error was carried forward to his DD Form 214. 2. Item 19c (Date of Entry) of his DD 214 is clearly incorrect. The month of November has 30 days. His DD Form 4, item 8 shows his service entry date as 1 December 1962. 3.
