Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, a correction to discharge Orders 08-1102000, dated 17 August 1977 to show his social security number (SSN) as XXX-XX-xx34 vice XXX-XX-xx35. 2. The applicant states the SSN on his discharge Orders is incorrect by one digit. His correct SSN is XXX-XX-xx34. 3. The applicant provides a copy of his discharge Orders 08-1102000, issued by the Office of the Adjutant General (OAG), Reserve Components Personnel and Administration Center, dated 17 August 1977. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 9 June 1962, the applicant was issued a letter of appointment in the U.S. Army Reserve (USAR) as a second lieutenant (2LT). The letter shows his service number vice his SSN. 3. On 14 November 1962, the applicant was ordered to active duty, and he was honorably released on 7 November 1964. His DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) lists his SSN in item 32 (Remarks) as XXX-XX-xx34. 4. The only other document in the applicant’s official military personnel file showing his SSN as XXX-XX-xx34 is his DA Form 41 (Record of Emergency Data), dated 28 February 1965. All other documents show his service number or list his SSN as XXX-XX-xx35. 5. The applicant provides a copy of Orders 08-1102000, issued by the OAG, Reserve Components Personnel and Administration Center, St. Louis, MO, dated 17 August 1977, which shows his SSN as XXX-XX-xx35. REFERENCES: Army Regulation 635-5 (Separation Documents), dated 23 May 1972, prescribes the separation documents that will be furnished each individual who is separated from the Army including active duty for training (ADT) personnel and cadets from the US Military Academy. The purpose of a separation document is to provide the individual with documentary evidence of his military service. It is a vital record for interested Government agencies which assists the veteran in obtaining the rights and benefits to which he is entitled. It is important that information entered thereon be complete and accurate. Accordingly, local procedures will be established to insure that entries on the forms are verified against source documents for completeness and accuracy. DISCUSSION: 1. The applicant contends, in effect, that discharge Orders 08-1102000, issued by the OAG, Reserve Components Personnel and Administration Center, St. Louis, MO, dated 17 August 1977, should be corrected to show his correct SSN as XXX-XX-xx34. 2. The evidence of record shows the applicant’s DD Form 214 and a DA Form 41 list his SSN as XXX-XX-xx34.
