The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the following awards to his DD Form 214: * Army Commendation Medal * Army Good Conduct Medal (1st Award) * Driver and Mechanic Badge with Driver-W Bar 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty)to show award of the Army Commendation Medal, Army Good Conduct Medal, Driver and Mechanic Badge, and Certificate of Achievement. 2. The applicant states this information was never added to his military file. 3. The applicant provides the following documents: * Certificate of Achievement * Army Commendation Medal Certificate * Permanent Order Number 60-17, awarding the Army Commendation Medal * Permanent Orders Number 31-30, awarding the Army Good Conduct Medal * Permanent Orders Number 36-20, awarding the Driver and Mechanic Badge with Driver-W Bar (for wheeled vehicles) CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 23 May 1979 and he was honorably discharged on 22 May 1982 due to completion of required service. 3. He provided the following documents: a. Certificate of Achievement, dated 16 June 1981, for meritorious service from 15 March through 30 June 1981 while he was assigned as the primary driver for the Chief of Staff, 2nd Armored Division. b. Army Commendation Medal Certificate, dated 8 April 1982, showing he was awarded the Army Commendation Medal for exceptionally meritorious service from 10 January 1980 through 19 June 1982. 4. Orders published by Headquarters, 2nd Armored Division showing: a. Permanent Order Number 60-17, dated 9 April 1982, awarded the applicant the Army Commendation Medal for meritorious service from 10 January 1980 through 19 June 1982. b. Permanent Orders Number 31-30, dated 23 February 1982, awarded the applicant the Army Good Conduct Medal for the period 23 May 1979 to 22 May 1982. c. Permanent Orders Number 36-20, dated 4 March 1982, awarded the applicant the Driver and Mechanic Badge-W Bar (for wheeled vehicles) for one year of fault free driving. REFERENCES: 1. Army Regulation 635-5 (Separation Documents) in effect at the time states to list awards and decorations for all periods of service in the priority sequence specified in Army Regulation 600-8-22 (Military Awards). 2. Army Regulation 600-8-22 provides the order of precedence for awards and decorations. Only decorations, medals, and ribbons are listed. Certificates of achievement, letters of appreciation, and similar documents are not listed. DISCUSSION: 1. Orders show the applicant was awarded the Army Commendation Medal, Army Good Conduct Medal (1st Award), and Driver and Mechanic Badge with Driver-W Bar. These awards are not reflected on his DD Form 214. 2. The available evidence shows the applicant received a Certificate of Achievement.
