Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Army Commendation Medal (3rd Award) and the Noncommissioned Officer Professional Development Ribbon with Numeral 2. 2. The applicant states, in effect, she was awarded three Army Commendation Medals and she successfully completed the Basic Noncommissioned Officer Course (BNCOC) for her military occupational specialty (MOS); however, the information is not listed on her DD Form 214. 3. The applicant provides: * three Army Commendation Medal certificates * two Certificates of Completion of training * Certificate for Honor Graduate CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 17 November 1994. 3. The applicant provides and her record contains: a. Permanent Orders Number 334-5 issued by Headquarters, 1st Brigade, 4th Infantry Division awarding her the Army Commendation Medal for meritorious achievement for the period 3 August through 12 September 2000. b. Permanent Orders Number 301-16 issued by Headquarters, 3d Armored Cavalry Regiment, dated 28 October 2002, awarding her the Army Commendation Medal for meritorious service for the period 6 March 2001 through 31 October 2002. c. Permanent Orders Number 98-02 issued by Headquarters, 3d Armored Cavalry Regiment, dated 8 April 2002, awarding her the Army Commendation Medal for meritorious achievement for the period 19 February through 21 March 2002. 4. Her record also contains: a. DA Form 1059 (Service School Academic Evaluation Report), dated 6 March 2002, which shows she successfully completed BNCOC (PH1) 008-02(5) by achieving the course standards for the period 19 February to 6 March 2002. b. DA Form 1059, dated 21 March 2002, which shows she successfully completed BNCOC (71L) (PH2) 011-02 by exceeding the course standards for the period 7 through 21 March 2002. 5. On 17 September 2003, the applicant was honorably discharged. The DD Form 214 she was issued shows she was awarded or authorized the: * Army Achievement Medal (3rd Award) * Army Commendation Medal * Army Good Conduct Medal (2nd Award) * National Defense Service Medal * Armed Forces Service Medal * Noncommissioned Officer's Professional Development Ribbon * North Atlantic Treaty Organization Medal * Army Service Ribbon * Overseas Service Ribbon * Expert Marksmanship Qualification Badge with Rifle Bar (M-16) 6. Item 14 (Military Education) of her DD Form 214 shows she completed the: * Administrative Specialist Course, 8 Weeks, 1995 * Primary Leadership Development Course, 4 Weeks, 1999 REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) states the Noncommission Professional Development Ribbon was established by the Secretary of the Army on 10 April 1981. It is awarded to Active Army, Army National Guard, and U.S. Army Reserve Soldiers for successful completion of designated noncommissioned officer professional development courses. Effective 30 March 1989, a service member will be awarded the Noncommissioned Officer Professional Development Ribbon with the numeral that identifies the highest level of Noncommissioned Officer Education System successfully completed. The Numeral 2 equates to the Basic Level. Acceptable evidence of graduation is a diploma, certificate, or a letter signed by an appropriate service school official. 2. Army Regulation 635-5 (Separation Documents) provides instructions for completing the DD Form 214. The version in effect at the time stated for item 14 list formal in-service (full-time attendance) training courses completed during the period of service covered by the DD Form 214. Courses were to be listed by title, length in weeks, and month and year completed. The information was intended to assist the Soldier after separation in job placement and counseling; therefore, training courses for combat skills were not listed. DISCUSSION: 1. Permanent orders awarded her the Army Commendation Medal (3rd Award); however, these awards are not shown on her DD Form 214. 2.
