Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show missing awards, educational training, and foreign service. 2. The applicant states, in effect, his DD Form 214 does not show the Army Commendation Medal (ARCOM), which was awarded to him on 20 September 1989; unspecified Army training; or his foreign service in South America. 3. The applicant provides: * DD Form 1610 (Request and Authorization for Temporary Duty (TDY) Travel of Department of Defense (DoD) Personnel), dated 28 May 1985, with attached list * DD Form 1610, dated 27 June 1987, with attached list * Army/American Council on Education Registry Transcript, dated 11 May 1987 (two pages) * two military personnel records * Army Leave and Earnings Statement (LES) for the month of March 1988 * DD Form 2774 (Certificate of Recognition), undated * an electronic version of his DA Form 2A (Personnel Qualification Record – Part I), prepared on 5 July 1988 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 1 December 1983 and was awarded military occupational specialty (MOS) 68B (Aircraft Powerplant Repairer). 3. The applicant' record contains: a. Permanent Orders 003-34, issued by Headquarters, Fort Carson and Headquarters, 4th Infantry Division (Mechanized), Fort Carson, CO, on 7 January 1986, which awarded him the ARCOM for meritorious service during the period 1 July 1985 through 1 November 1985. b. A DA Form 4980-14 (ARCOM Certificate) that shows he received the ARCOM for exceptionally meritorious service while assigned to Task Force Cougar, in the Republic of Honduras, during the period 1 July 1985 through 1 November 1985. c. Permanent Orders 032-12, issued by Headquarters, 4th Aviation Brigade, 4th Infantry Division (Mechanized), Fort Carson, CO on 28 April 1988, which awarded him the Army Achievement Medal (AAM) for meritorious service during the period 18 February 1987 through 1 July 1987. d. A DA Form 4980-18 (AAM Certificate) that shows he received the AAM for exceptional meritorious service while assigned to the Aviation Intermediate Maintenance Support Section of Task Force Iron Eagle, Palmerola Air Base, Comayagua, Honduras, during the period 18 February 1987 through 1 July 1987. e. A DA Form 1059 (Service School Academic Evaluation Report), dated 14 April 1988, which shows he successfully completed the Primary Leadership Development Course (PLDC) from 18 March 1988 through 14 April 1988. f. Permanent Orders 088-01, issued by Headquarters, 4th Aviation Brigade on 20 September 1989, which awarded him the ARCOM (First Oak Leaf Cluster) for meritorious service during the period 3 August 1983 through 1 August 1989. 4. The applicant was honorably discharged on 2 November 1989 by reason of expiration term of service. He completed 5 years, 11 months and 2 days of net active service this period. His DD Form 214 shows in: a. Item 12f (Foreign Service), no foreign service time. b. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), he was awarded of authorized the: * ARCOM * Army Good Conduct Medal * Humanitarian Service Medal * Army Service Ribbon * NCO Professional Development Ribbon * Aircraft Crewman Badge * Expert Marksmanship Qualification Badge with Rifle Bar (M-16) * Army Lapel Button c. Item 14 (Military Education (Course Title, number weeks, and month and year completed), the entry "Aircraft Powerplant Repairer 17 weeks, (Aug 84)." d. Item 18 (Remarks), no entry for a deployment period. 5. The applicant provides: a. two DA Forms 1610 that show he was put on orders authorizing him travel to Honduras, with identifying deployment orders, in April 1985 and January 1987; b. an Army/American Council on Education Registry Transcript, dated 11 May 1987, which shows he was trained in his MOS. Additionally, two documents that highlight his experience on aircraft repair systems; c. an Army leave and earnings statement for the month of March 1988. It is unclear as to the intent of this document; d. A Certificate of Recognition signed by the Secretary of Defense, in recognition of his service during the Cold War period; and e. His DA Form 2A, prepared on 5 July 1988, which summarizes his military service. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for preparation of the DD Form 214. It states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. It is important that information entered on the form is complete and accurate. Chapter 2 contains specific guidance for preparation of the DD Form 214. The instructions state for: a. item 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214; b. item 13, enter decorations, etc., awarded or authorized for all periods of service; c. item 14, list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by title, length in weeks, and month and year completed. This information is to assist the Soldier after separation in job placement and counseling; therefore, training courses for combat skills will not be listed; and d. item 18, for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)." DISCUSSION: 1. The applicant's request for correction of his DD Form 214 to show missing awards, educational training, and foreign service was carefully considered. 2. Permanent orders awarded the applicant the AAM on 28 April 1988 and the ARCOM (1st Oak Leaf Cluster) on 20 September 1989; however, these awards are not listed on his DD Form 214. 3. The available evidence shows the applicant was ordered to deploy in support of operations in the Republic of Honduras on two separate occasions. The first deployment occurred from 1 July 1985 through 1 November 1985, a period of 4 months. The second deployment occurred from 18 February 1987 through 1 July 1987, a period of 4 months and 14 days. He was awarded the ARCOM and the AAM, respectively, for these periods of service. 4. The applicant's service in Honduras totaled 8 months and 14 days; however, his DD Form 214 does not properly account for his cumulative foreign service. Specifically, items 12f and 18 lack appropriate entries that credit him with the completion of foreign service. 5. The applicant completed PLDC on 14 April 1988; however, this military education is not listed on his DD Form 214. 6.
