The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending her records to show her home of record as Las Vegas, NV, as it appears on her DD Form 1966/1.

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of her records to show her home of record (HOR) as Las Vegas, NV, instead of San Jose, NV.

2.  She states there is no San Jose, NV, as listed on her Enlisted Record Brief (ERB). 

3.  She provides her self-authored statement and an ERB.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Delayed Entry Program on 21 July 2010 and entered active duty on 18 January 2011.  She is currently serving as a sergeant (SGT)/E-5 on active duty.

2.  Item 3 (HOR) of her DD Form 4/1 lists her HOR as San Jose, CA.

3.  Her DD Form 1966/1 (Section I - Personal Data) lists her current address as San Jose, CA, and her HOR as Las Vegas, NV.  Additionally, her 1966/2 (Section III - Other Personal Data) shows she attended the University of Nevada, Las Vegas, from August 1999 to August 2003 and the Community College of Southern Nevada, Las Vegas, NV, from August 2005 to May 2007.

4.  Her ERB, dated 7 December 2015, lists her HOR as San Jose, NV.

5.  A review of cities in Nevada confirms that San Jose, NV does not exist.

REFERENCES:

The Joint Federal Travel Regulation, Appendix A, Part 1 provides that the HOR is the place recorded as the individual’s home when commissioned, appointed, enlisted, inducted, or ordered into a tour of active duty.  There is no authority to change the HOR as officially recorded at time of entry into the military service.  However, there is authority to correct a HOR if erroneously entered on the records at that time, and then only for travel and transportation purposes.  Correction of the HOR must be based on evidence that a bona fide error was made and the HOR as corrected must have been the actual home of the individual at the time of entry into the relevant period of service.

DISCUSSION:

1.  It appears an error occurred in the processing of the applicant's enlistment contract.  Her HOR is listed on her DD Form 4/1 as San Jose, CA.  However, her DD Form 1966/1 lists her HOR as Las Vegas, NV.  The evidence of record also shows the applicant attended college in Las Vegas, NV, prior to her enlistment in the Army. 

2.  Her ERB lists her HOR as San Jose, NV, a city that does not exist.
