Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) to show his social security number (SSN) as 504-XX-XXXX instead of 907-00-XXXX. 2. The applicant states his SSN given at birth was 504-XX-XXXX. The DD Form 214 given to him at the time of his honorable discharge listed his SSN as 907-XX-XXXX. The person entering his information assigned the temporary identification number of 907-XX-XXXX because he did not have his social security card with him when he registered for basic training in Denver, CO. 3. The applicant provides a copy of his Colorado driver's license and Department of Veterans Affairs identification card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. During the processing of the applicant's enlistment in the Army, he completed a DD Form 398 (Statement of Personal History) on 5 July 1972, which lists his SSN as 504-XX-XXXX in item 13 (Employment). 3. On 6 July 1972, the applicant enlisted in the Regular Army. His DD Form 4 (Enlistment Contract – Armed Forces of the United States) shows his SSN as 907-XX-XXXX. 4. All of the applicant's records list his SSN as 907-XX-XXXX, except his DD Form 398. 5. On 27 June 1974, the applicant was honorably released from active duty and transferred to the U.S. Army Reserve Control Group. Item 3 (SSN) of his DD Form 214 lists his SSN as 907-XX-XXXX. 6. The applicant provided a copy of his driver's license and Department of Veterans Affairs identification card. Neither document lists his SSN. REFERENCES: 1. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. This regulation established standardized policy for preparation of the DD Form 214. The instructions stated the complete name and SSN of the separating service member would be entered on the DD Form 214. 2. Army Regulation 600-2 (Name and Birth Data, Social Security Account Number, and Temporary Identification Number (TIN)), effective 1 July 1969, announced the use of the SSN in lieu of military service numbers. A TIN would be issued during the pre-enlistment processing for entrance into the Active Army to those individuals who did not have an SSN. The TIN was a 9-digit number that always began with the number "9." Upon receipt of an SSN, the TIN entry on all records would be lined out and the SSN would be entered. DISCUSSION: The applicant's DD Form 398 shows he disclosed his SSN as 504-XX-XXXX during processing of his enlistment in the Regular Army.
