Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the social security number (SSN) reflected on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). 2. The applicant states the SSN on his DD Form 214 for the period ending 28 August 1967 is incorrect. Instead of XXX-XX-xxxx it should read XXX-XX-xxxx. 3. The applicant provides a copy of his social security card, Medicare health insurance card, and DD Form 214 for the period ending 28 August 1967. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. In connection with his enlistment in the Regular Army, the applicant completed a DD Form 398 (Statement of Personal History) and listed his SSN as XXX-XX-xxxx. 3. The applicant enlisted in the Regular Army on 3 September 1964. He held military occupational specialty 11B (Light Weapons Infantryman). 4. His available service record shows his military service number was primarily used throughout his term of active service. 5. He was honorably released from active duty on 28 August 1967. His DD Form 214 shows he completed 2 years, 11 months, and 26 days of net active service. Item 3 (SSN) lists his SSN as XXX-XX-xxxx. 6. The applicant provides a photocopy of a social security card showing his SSN as XXX-XX-xxxx. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The regulation directs that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form should be complete and accurate. With regard to item 3, the regulation required the SSN to be taken from the DA Form 2139 (Military Pay Voucher). DISCUSSION: The evidence shows the SSN listed on his DD Form 398 and social security card (XXX-XX-xxxx) is his correct SSN.
