Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as XX5-76-XXXX. 2. The applicant states the SSN shown on his DD Form 214 as XX5-67-XXXX is inaccurate. His correct SSN is XX5-76-XXXX. 3. The applicant provides: * DD Form 214 * Georgia Department of Veterans Service veteran summary printout CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 5 January 1967, the applicant was inducted into the Army of the United States. The DD Form 47 (Record of Induction) shows his SSN as XX7-67-XXXX. 3. His DA Form 20 (Enlisted Qualification Record) shows his SSN as XX7-67-XXXX. 4. His Fort Benning (Army Training Center) Form 3 (Processing Data Card), dated 5 January 1967, shows SSN as XX5-76-XXXX. 5. 339th Supply Company (General Support), Japan, Unit Orders Number 46, dated 21 May 1968, show his as SSN XX5-76-XXXX. 6. He was honorably released from active duty on 20 December 1968. Item 3 (Social Security Number) of his DD Form 214 shows his SSN as XX5-67-XXXX. 7. Office of the Adjutant General, U.S. Army Reserve Components Personnel and Administration Center, St. Louis, MO, Letter Orders Number 12-1467302, dated 19 December 1972, discharging him from the U.S. Army Reserve, show his SSN as XX5-76-XXXX. 8. His records do not contain a DA Form 2139 (Military Pay Voucher). 9. He provided a Georgia Department of Veterans Service veteran summary printout showing his SSN as XX5-67-XXXX. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It established standardized policy for preparing and distributing the DD Form 214. The general instructions stated all available records would be used as a basis for preparation of the DD Form 214. The specific instructions for item 3 stated to transcribe the SSN from the individual's DA Form 2139. DISCUSSION: The applicant's records contain a processing data card, unit orders, and letter orders showing his SSN as XX5-76-XXXX.
