THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his correct social security number (SSN) in item 3 (SSN). 2. The applicant states his DD Form 214 lists his SSN as XXX-XX-xxxx; the correct SSN is XXX-XX-xxxx. 3. The applicant provides his DD Form 214 and his SSN card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 7 January 1965. He held military occupational specialty 94B (Cook). 3. He was honorably released from active duty on 10 January 1968 based on the expiration of his term of service. His separation orders (Special Orders Number 8, dated 10 January 1968, issued by Headquarters, Personnel Center U.S. Army Garrison Troop Command) lists his SSN as XXX-XX-xxxx. His DD Form 214 shows he completed 3 years and 4 days of net active service. Item 3 reflects his SSN as XXX-XX-xxxx. 4. Memorandum, dated 24 January 1968, Subject: U.S. Army Reserve (USAR) Assignment, indicates his SSN was XXX-XX-xxxx. 5. The applicant provides his SSN card that reflects his SSN as XXX-XX-xxxx. REFERENCES: Army Regulation 635-5 (Personnel Separations - Separation Documents), in effect at the time, prescribed policies and procedures for the completion of the DD Form 214. Source documents include the DA Form 20 as well as orders. This regulation essentially states item 3 will show the SSN, as listed in source documents. DISCUSSION: The evidence indicates the SSN listed as XXX-XX-xxxx on both his separation orders, dated 10 January 1968, and a memorandum detailing his follow-on USAR assignment, is his correct SSN.
