THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the social security number (SSN) shown on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). 2. The applicant states a typographical error was made at the time of his discharge. His SSN is an extremely important number for identification purposes as is his DD Form 214; therefore, he feels it is important that they are correct. 3. The applicant provides his DD Form 214 and social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations. 2. The applicant records contain a DD Form 398 (Statement of Personal History), dated 1 April 1964, listing his SSN as xxx-xx-xxx5. 3. He was inducted into the Army of United States on 2 April 1964. His DD Form 47 (Record of Induction) identified him by his service number. It did not list his SSN. 4. His records also contain a DA Form 41 (Record of Emergency Data), dated 21 September 1964, listing his SSN as xxx-xx-xxx5. 5. He was honorably released from active duty on 29 March 1966 and was transferred to the U.S. Army Reserve. Item 32 (Remarks) of his DD Form 214 lists his SSN as xxx-xx-xxx3. 6. He provides his social security card listing his SSN as xxx-xx-xxx5. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, governed the preparation of the DD Form 214. It stated the DD Form 214 would be prepared for all personal at the time of their retirement, discharge, or release from active duty. The regulation stated item 32 would list the SSN verified in the Soldier's records. DISCUSSION: The evidence of record contains at least two documents showing the applicant's SSN as shown on his social security card.
