The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period ending 30 October 1969 to show his specialty number and title as 67N20 (Utility Helicopter (UH-1) Helicopter Repairman) vice 67U20 (CH-47 Helicopter Repairman). 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period ending 30 October 1969 to show he served in two aviation specialties during his period of military service. 2. The applicant states, in effect, he began his service in military occupational specialty (MOS) 67N (Utility Helicopter (UH-1) Helicopter Repairman); however, when he was sent to the Republic of Vietnam, he spent more time as a team leader serving in the duties associated with MOS 67U (CH-47 Helicopter Repairman). 3. The applicant provides a self-authored statement and a DD Form 2658 (Health Record – Abstract of Service). CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 31 October 1966 for training in MOS 67N. 3. Special Orders Number 65, issued by U.S. Army Transportation School, Fort Eustis, VA on 4 April 1967, awarded him MOS 67N20 as his primary specialty. 4. The applicant's DA Form 20 (Enlisted Qualification Record) shows in: a. Item 22 (MOS), his primary MOS was 67N2O effective 4 April 1967 and his secondary MOS was 67U2O effective 7 August 1969; b. Item 31 (Foreign Service), he served in the Republic of Vietnam from on or about 10 December 1967 through on or about 9 December 1968; and c. Item 38 (Record of Assignments), his unit of assignment in the Republic of Vietnam was the 608th Transportation Company and his duty MOS was 67N20. 5. Special Orders Number 156, issued by Headquarters, 1st Medical Group, Fort Sam Houston, TX on 7 August 1969, awarded him MOS 67U2O as his secondary MOS. 6. Special Orders Number 217, issued by Headquarters, Fort Sam Houston, TX on 15 October 1969, released him from active duty on 30 October 1969. These orders listed his MOS as 67N20. 7. The applicant's DD Form 214 confirms he was honorably released from active duty on 30 October 1969. Item 23a of his DD Form 214 shows the entry "67U2O CH-47 [Helicopter] Repairman." 8. The applicant's records do not contain orders withdrawing MOS 67N2O as his primary specialty. 9. The applicant provides: a. A self-authored statement that indicates he arrived in the Republic of Vietnam as a UH-1 Helicopter Repairman and was sent to school in country for CH-47 Helicopter Repairman training. He states he worked on both types of helicopters while in the Republic of Vietnam. b. A DA Form 2658 that shows his servicing medical and dental activities during the period 7 November 1966 through 13 January 1969. REFERENCES: 1. Army Regulation 611-201 (Enlisted Career Management Fields and Military Occupational Specialties), in effect at the time, provided that the official title for MOS 67N was UH-1 Helicopter Repairman and MOS 67U was CH-47 Helicopter Repairman. 2. Army Regulation 635-5 (Separations Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Active Army. It provided that the DD Form 214 was a synopsis of the Soldier's most recent period of continuous active duty. The DD Form 214 provided a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. For item 23a (Specialty Number and Title), the preparer should enter the separating Soldier's primary MOS code number and title. DISCUSSION: 1. The applicant requests correction of his DD Form 214 to show he served in two aviation MOSs during his period of military service. 2. The applicant contends he worked in both MOSs; therefore, he should have both listed on his DD Form 214. The evidence of record shows he was awarded MOS 67N2O as his primary specialty on 4 April 1967. He was subsequently awarded MOS 67U2O as his secondary specialty on 7 August 1969. 3. The governing regulation in effect at the time of his separation provides item 23a of the DD Form 214 would show the separating Soldier's primary specialty number and title held during the period of active duty represented by the DD Form 214. The applicant's DD Form 214 lists his secondary MOS 67U2O in item 23a. Therefore, there appears to be an administrative error in the preparation of his DD Form 214. 4.
