THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period from 20 March 2015 through 24 February 2016 to show in: * Item 12d (Total Prior Active Service) – active duty (AD) credit for the period from 16 April 2010 through 16 May 2011, a total of 1 year, 1 month, and 1 day * Item 19a (Mailing Address After Separation) – "P.O. Box XXX, Oxon Hill, MD 20945" instead of "P.O. Box XX, Fort Deposit, AL 36032" 2. The applicant states, in effect, the AD dates listed in item 5 of Orders 098-098 were not credited in item 12d of his 2016 DD Form 214. Item 19a of this DD Form 214 should also list his address in Oxon Hill, MD, instead of Deposit, AL. These are systematic errors that need to be corrected to increase the retirement points he earned through a valid active duty term. 3. The applicant provides Orders 098-098 and his 2016 DD Form 214. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army (RA) on 17 November 1993. He was honorably released from AD (REFRAD) on 8 March 1996 and was transferred to a Reserve unit. His DD Form 214 show he completed 2 years, 3 months, and 22 days of active service. 2. He enlisted in the New York Army National Guard (NYARNG) on 9 March 1996. He entered AD in support of Operation Enduring/Iraqi Freedom (OEF/OIF) on 10 February 2003 and served in Kuwait/Iraq from 20 April 2003 to 19 April 2004. He was honorably REFRAD on 25 May 2004 and was transferred to the NYARNG. His DD Form 214 for this period lists in: * Item 12a (Date Entered AD This Period) – 10 February 2003 * Item 12b (Separation date This Period) – 25 May 2004 * Item 12c (Net Active Service This Period) – 1 year, 3 months, and 16 days * Item 12d (Total Prior Active Service) – 2 years, 3 months, and 22 days 3. He entered AD in support of OIF on 16 April 2010 and served in Iraq from 1 June 2010 to 3 April 2011. He was honorably REFRAD on 16 May 2011 and was transferred to the NYARNG. His DD Form 214 lists in: * Item 12a – 16 April 2010 * Item 12b – 16 May 2011 * Item 12c – 1 year, 1 month, and 1 day * Item 12d – 4 years, 4 months, and 27 days 4. He entered AD in support of OEF on 20 March 2015. He was deployed to Guantanamo Bay, Cuba, from 17 April 2015 through 22 January 2016. He was honorably REFRAD on 24 February 2016 and was transferred to the NYARNG. His DD Form 214 lists in: * Item 12a – 20 March 2015 * Item 12b – 24 February 2016 * Item 12c – 11 months and 5 days * Item 12d – 4 years, 8 months, and 9 days * Item 19a – P.O. Box XX, Fort Deposit, AL 36032 * Item 21a (Member Signature) – his electronic signature and the date of 29 January 2016 5. He served continuously in the NYARNG until he was honorably retired on 26 March 2017. 6. An ARNG Current Annual Statement, dated 15 May 2017, shows he served: * in the RA from 17 November 1993 through 8 March 1996 * in the ARNG from 9 March 1996 through 26 March 2017 * on ARNG mobilized service from: * 10 February 2003 through 25 May 2004 * 16 April 2010 through 15 May 2010 * 20 March 2015 through 24 February 2016 REFERENCE: Army Regulation 635-8 (Personnel Separations – Separation Processing and Documents), dated 10 February 2014, prescribes the transition function of the military personnel system. It states a DD Form 214 will be prepared for all personnel upon retirement, discharge, and REFRAD for mobilized ARNG Soldiers mobilized under Title 10, U.S. Code, sections 12301(a), 12302, or 12304, and ARNG Soldiers called into Federal service under Title 10, U.S. Code, chapter 15 or section 12406, regardless of length of mobilization, when transitioned from active duty. The regulation states: * Item 12a – will list the beginning date of the continuous period of active duty for issuance of the DD Form 214 or for which a DD Form 214 was not previously issued * Item 12b – will list the Soldier's transition date * Item 12c – will list the amount of service that period, computed by subtracting item 12a from 12b, less time lost * Item 12d – will list, from previously issued DD Forms 214, total amount of prior active service * Item 19a – will be provided by the Soldier and must be a permanent address; there are no provisions for changing this address at a later date for the convenience of the Soldier DISCUSSION: 1. With respect to correction of item 12d of his 2016 DD Form 214: a. The evidence shows the applicant served in the RA from 17 November 1993 through 8 March 1996, a period of 2 years, 3 months, and 22 days. He was issued a DD Form 214 capturing this period of AD. b. He was mobilized and served on AD from 10 February 2003 through 25 May 2004. He was issued a DD Form 214 that captured his 1 year, 3 months, and 16 days of active service during this period as well as his 2 years, 3 months, and 22 days of prior active service, for a total of 3 years, 7 months, and 8 days. c. He was mobilized again and served on AD from 16 April 2010 through 16 May 2011. He was issued a DD Form 214 that captured his 1 year, 1 month, and 1 day of active service during this period. However, instead of crediting him with 3 years, 7 months, and 8 days of prior active service, this DD Form 214 credited him with 4 years, 4 months and 27 days of prior active service. d. Although this DD Form 214 contained an administrative error, his total active duty service as of 16 May 2011 equated to 4 years, 8 months, and 9 days. Should the Board determine relief is warranted, item 12d of the applicant's DD Form 214, for the period ending on 16 May 2011, may be corrected to show a credit of 4 years, 8 months, and 9 days of prior active service. e. He was again mobilized and served on AD from 20 March 2015 through 24 February 2016. He was issued a DD Form 214 that captured his 11 months and 5 days of AD as well as his 4 years, 8 months, and 9 days of prior active service. This DD Form 214 contains no errors with respect to his total prior active service. 2. With respect to correction of the mailing address in item 19a of his DD Form 214 covering the period 20 March 2015 to 24 February 2016, the entry pertaining to the mailing address after separation is provided by the Soldier to the official preparing the DD Form 214. The applicant appears to have provided his mailing address after separation as shown on his DD Form 214.
