THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he was transferred to the Retired Reserve versus discharged by reason of Non-Retention on Active Duty. 2. He states, in effect, he received amended orders assigning him to the Retired Reserve after he was discharged. 3. He provides: * DD Form 214 * Orders C-08-512569, dated 19 August 2015 * Orders D-08-590190, dated 19 August 2015 * Orders C-10-599501, dated 19 October 2015 * Orders D-10-590190R, dated 19 October 2015 * Orders C-10-515450, dated 29 October 2015 * DA Form 5016 (Chronological Statement of Retirement Points), dated 14 June 2017 CONSIDERATION OF EVIDENCE: 1. The applicant was born on 14 November 1968. He will reach age 60 in 2028. He served in the U.S. Army Reserve (USAR) and Active Guard Reserve (AGR) prior to his discharge. The applicant was promoted to sergeant first class (SFC/E-7) on 1 September 2000. 2. He received a 20-Year Letter, dated 11 February 2010, which shows he completed 20 qualifying years of non-regular military service for retired pay at age 60. 3. His record shows he was denied promotion and continued service under qualitative Management Program. On 14 October 2015, he requested to be released from active duty for the purpose of non-regular retirement at age 60 and to be placed on the Retired Reserve List. The record is void of an approval from the U.S. Army Human Resources Command (HRC). 4. Orders C-08-512569, dated 19 August 2015, the applicant to Fort Carson, CO for separation processing effective 30 October 2015. 5. The following orders were provided by the applicant; however, they are not filed in his military record: a. HRC Orders D-08-590190, dated 19 August 2015, discharging the applicant from the USAR/AGR, effective 1 November 2015. b. HRC Orders D-10-590190R, dated 19 October 2015, revoking Orders D-10-590190 pertaining to the applicant’s discharge. c. HRC Orders C-10-599501, dated 19 October 2015, releasing the applicant from active duty and assigning him to the USAR Control Group (Reinforcement), effective 1 November 2015. 6. Orders C-10-515450, dated 29 October 2015, released the applicant from the USAR Control Group Reinforcement, and transferred him to the Retired Reserve effective 3 November 2015. His orders state the "SERVICE MEMBER IS NON- SELECT FOR RETENTION UNDER QUALITATIVE MANAGEMENT PROGRAM NOT ELEGIBLE TO RETURN FROM RETIREMNT IN ACCORDANCE WITH (AR) 140-10, CHAPAPTER 6." 7. His DD Form 214 shows he was discharged on 1 November 2015, under the provisions of Army Regulation 635-200, Chapter 4, by reason of Non-Retention on Active Duty. He received a separation code of "JGH" and a reentry code of "4." REFERENCES: 1. Army Directive 2014-06 (Qualitative Management Program), dated 10 April 2014 was applicable to Regular Army and USAR (AGR) Soldiers. This directive: a. Identified NCOs for denial of continued service when their performance, conduct, or potential for advancement did not meet Army standards for continued service, as determined by a Headquarters Department of the Army centralized selection board responsible for QMP selection. b. Regular Army and AGR Soldiers with 20 or more years of qualifying service for a non-regular retirement as of the established discharge date could submit a request for discharge (Regular Army) or a request for release from active duty (AGR) with concurrent transfer to the Retired Reserve. DISCUSSION: 1. The applicant contends his DD Form 214 should be corrected to show he was transferred to the Retired Reserve; however, the available evidence shows he was non-select for retention under the QMP and he was discharged for that reason on 1 November 2015. 2. The applicant had sufficient service for a non-regular retirement, as such, HRC Orders C-10-515450, dated 20 October 2015, transferred him to the Retired Reserve, effective 3 November 2015. The effective date of his transfer is subsequent to his discharge. 3. The type of discharge directed and the reasons therefore were appropriate considering all of the facts of the case.
