Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his records to shows his home of record (HOR) as Colton, CA, vice Gainesville, FL. 2. The applicant states: a. His initial orders onto active duty, dated 26 March 2003, state his HOR was Gainesville, FL. This error was not discovered until his separation orders were created and it adversely affects his shipment of his personal property to his HOR. He has spoken to, and was advised by, the transportation personnel, separation personnel, and his branch manager to correct this error in order for his personal property to be shipped to his correct HOR without his incurring additional expenses. b. His correct HOR can be found on his initial active duty orders (Colton, CA). That is where he resided when he took his Oath of Office and when he was ordered to active duty. He has never been to Gainesville, FL, nor has he ever resided in FL at any time. 3. The applicant provides: * two DA Forms 71 (Oath of Office - Military Personnel) * Officer Record Brief (ORB) * orders CONSIDERATION OF EVIDENCE: 1. The applicant was appointed as a second lieutenant in the U.S. Army Reserve (USAR) on 28 April 2000 and he executed an Oath of Office at Santa Ana, CA, on that date. 2. Orders C-09-025328, dated 12 September 2000, issued by the U.S. Total Army Personnel Command (TAPC), assigned him to a USAR Control Group effective 28 April 2000. These orders show his address at the time as Redlands, CA. 3. Orders A-03-391171, dated 26 March 2003, issued by TAPC, ordered him to active duty with a report date of 13 June 2003 to Madigan Army Medical Center, Fort Lewis, WA. These orders show his address at the time as Colton, CA, and his HOR as Gainesville, FL. 4. On 25 May 2003, he was appointed as a captain Reserve officer and he executed an Oath of Office at Loma Linda, CA, on that date. He entered active duty on 13 June 2003. 5. On 16 July 2012, he was assigned to Brooke Army Medical Center, Fort Sam Houston, TX. On 13 June 2015, he was promoted to the rank of lieutenant colonel (LTC) in the Regular Army. 6. On 16 November 2015, his request for an unqualified resignation was accepted by the U.S. Army Human Resources Command (HRC) with an effective release date of 1 July 2016. 7. Orders 012-1106, dated 12 January 2016, issued by Headquarters (HQ), U.S. Army North (Fifth Army), Joint Base San Antonio (JBSA), Fort Sam Houston, reassigned him to the U.S. Army Transition Point, JBSA, with a reporting date of 31 May 2016 and discharge date of 1 July 2016. These orders show his HOR as Gainesville, FL. 8. The applicant provides his ORB, dated 19 February 2016, wherein it shows his HOR at the time of his entry on active duty as CA. REFERENCES: Army Regulation 600-8-104 (Army Military Human Resource Record Management) prescribes the policies governing the official military personnel file. Table 5-2 of this regulation states the term "HOR" means the place (city and state or country) recorded as the home of the individual when commissioned, reinstated, appointed, reappointed, enlisted, reenlisted, inducted, or ordered into the relevant tour of active duty. DISCUSSION: The evidence of record shows at the time the applicant was appointed as a Reserve officer in the USAR he was residing in CA and this is where he was residing when he entered active duty on 13 June 2003. It appears when Orders A-03-391171 were issued on 26 March 2003, his HOR was incorrectly listed as Gainesville, FL, instead of Colton, CA.
