Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 22 March 1999 to show her foreign service in Bosnia. 2. The applicant states, in effect, she would like her DD Form 214 corrected to show her deployment to Bosnia in support of Operation Joint Endeavor in order to qualify for a 5-point veteran's preference. She believes the deployment was not added because she was attached to another unit and the orders were not uploaded into her record. She did not look at her DD Form 214 closely enough when she was discharged. 3. The applicant provides a copy of her DD Form 214 and deployment orders in support of Operation Joint Endeavor. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 23 March 1995. 3. The applicant's DA Form 2-1 (Personnel Qualification Record – Part II) shows she was assigned to a unit in Germany, which was her permanent duty station from on or about 11 September 1995 through on or about 12 September 1997. 4. The applicant was honorably released from active duty on 22 March 1999. Her DD Form 214 shows in: * Block 12f (Foreign Service), the entry "0002 00 02," which indicates she was credited with 2 years and 2 days of foreign service * Block 18 (Remarks), the absence of an entry that references a deployment or her participation in any named operations 5. Defense Finance and Accounting Service (DFAS) records indicate the applicant received hostile fire pay/imminent danger pay and combat zone tax exclusion for service in Bosnia from 1 October 1996 through 31 March 1997. REFERENCES: Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It provides standardized policy for the preparation of the DD Form 214. Preparers of the DD Form 214 will use Block 18 to show an entry for an active duty Soldier who deployed to a foreign country with his or her unit during their continuous period of active service by entering the statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)." DISCUSSION: DFAS records confirm the applicant served in Bosnia from 1 October 1996 through 31 March 1997.
